The NSA’s attitude to the law and congressional oversight is basically the same as TMFWWNBN - it doesn’t apply to them.

I mean I’d much rather we don’t lose the House but even if the GOP Clown Car catches the dog, I’m fairly sure they’ll fumble the “what do we do with it” part that comes after

One thing we saw in (I think it was) the most recent committee hearing is that there were a LOT of witnesses to what went on, including witnesses of the Secret Service. I suspect that piecing together that mosaic will be what trips up these guys.

And once one or more get caught in that manner, the next step will likely be to flip them

Yes you are correct there. Without the Senate they have nothing. Without the House the Dems have nothing. We will have 2/3 ds of the government but still a stalemate. Messy for sure but better than GOP control.

Oh they’d probably follow thru to some extent on these threats to hold hearings and to “punish” companies that complied with subpoenas. I just don’t see that working out well for them.

Irrespective of that, though, we need to do everything we can to hold the House!

DHS will also review its electronic retention policies, and they’ve put a pause on wiping agents’ phone records until it’s complete.

From what I could glean from meanderings around the web it is apparent that the NSA has twice got in trouble for hoovering phone calls of Americans which is illegal for them to do. Their response has been “Oopsie, won’t do it again”. Further it is apparent that the NSA does in fact have the tech ability to capture phone calls in America. And anywhere else for that matter. I am saying this not from any :belief" but rather from what I could find on line that appeared to be factual. Some examples are what I posted up thread. The original post apparently as pointed out by @txlawyer was a parody site. so don;t trust that. A couple posts on I put up one for wikipedia that had a lot about the web capturing NSA does. And the NY Times had a story from 2018 describing the NSA’s ability to capture phone calls. So it’s not belief that I base this on. But rather apparent facts. But then it’s the web and what does one trust?

And this entire situation is why Eric Snowden can never come back to the US.

Love him or hate him, he revealed what the NSA was doing with all of that data they were collecting, without a warrant or FISA. Say what you will about him, but without him we wouldn’t know that this was even happening.

It’s why I’m not as confident as some are that those text messages that were ‘wiped’ really don’t exist anywhere. I’m just not entirely convinced. Dan Cummings ‘Time Suck’ did a whole thing on this recently, which I listened to with interest. Discredit it if you will.

With respect to the DHS/secret service/Pentagon:

What are the normal ongoing protocols for retaining text messages (and data) and back-ups?

What is the chain of command in each bureaucracy for administration of this retention protocol?

What authorizations are required?

What are the stated (written) policies for retaining text messages in the face of system upgrades?

What was the administrative response for retention in light of the January 6th insurrection?

Who signs off on record retention?

What memorialized conversations took place where analysis of Obstruction of Justice risk factors were discussed?

(etc.)

There is a ton of administrative structure, operational facts, and narrative to get straight before culpability can be surmised.

We know little. There is the appearance of a coordinated effort to obstruct justice. If true, this will take a lot of forensics and pointed questioning to smoke out. Commonsense dictates that backing up data files on a regular schedule is the usual way to keep an ongoing record of data separate from the primary or root device.

deleting data after the FBI shows an interest will get you in trouble, possibly worse trouble than the potential crime you’re covering up.

Common sense (the real world kind) says you probably don’t want to make backups of SS agents texting each other pizza orders and tips on which hooker gives the best head.
