Obviously, of course, a federal magistrate or judge has decided it is more likely than not that the senator’s phone contains evidence of a crime, but that’s far from the final word on this.

True! Given that the trial judge dismissed the securities fraud/insider trading charge. Albeit that the basis of the charge was that her brother leaked to her that ImClone’s big drug was failing FDA approval.
But she still went to prison for lying about it to government investigators and obstruction of justice. Lesson: Engage a knowledgeable attorney before deciding to talk to the feds. Better still, don’t talk to the feds except through counsel.
