Scalia got the message about ten years too late. Maybe eight years too late, because ten years ago W Bush would have been able to appoint some much younger Bork-lite to the court.

Definitely agree. The article is as much about Kennedy as Scalia, so let the dead stay dead. I probably couldn’t pick Kennedy out of a lineup, so more pics of him might be useful to some of us.
It appears he’s possessed Thomas, and moved him to interrogate for the first time in 10 years. I’m sure Clarence’s little mind is not inconvenienced by the presence of Scalia’s large ego taking up the master bedroom, living room, and kitchen of his brain.

A 4-4 tie means the judgement passed by the lower court stands. Not a good outcome for women in Texas.
A preferable outcome (for the likes of us) would be if Kennedy joins the sensible justices and makes it 5-3, then the supreme’s decision stands and is considered a precedent for similar cases in other circuits.

These laws have nothing to do with women’s health. It’s all about shutting down the clinics.

Good thing he didn’t take “regret,” “grief” and "sorrow” into consideration in the same-sex marriage case. He would have banned both same-sex and heterosexual marriages by that standard.

A 4-4 decision is the “outcome that would amount to a loss for abortion rights activists” because it would allow the decision of the 5th Circuit Court of Appeals to stand. The potential impact is blunted because its effect is limited to the 5th Circuit, i.e., the states of Texas, Louisiana and Mississippi.
