Discussion: Why Did Jared Kushner’s Attorney Let Him Speak To Robert Mueller's Team?

Another thought. If Jaworski had a list of crimes he was prepared to charge, why wasn’t that made very public despite the pardon? In the interest of serving the public, and transparency, and for the historical record, I fail to see why a pardon relieves the prosecution from divulging the list of probable charges they had that motivated the issuance of a pardon. Mueller could have Kushner nailed dead to rights on several crimes, via an investigation the public paid for. It would seem in the public interest to know what crimes Kushner was alleged to have committed, even were he pardoned and spared trial and punishment. The things he did could color and affect decisions by others in government going forward, especially in policy areas he held sway over.
Saying a person is pardoned for everything he did seems very much a blanket pardon. Qualifying how it’s defined by proclaiming “Well, yeah, there’s a slew of crimes he’s being let off the hook for, but we’re not going to tell you what they are, because hey, he’s pardoned, what’s it matter?” doesn’t cut it. If that’s the way it works we’ll never know what Kushner did, should Trump pardon him.

Every day that Jared Kushner’s smirking mug is on the front page of the newspaper is a day that Martin Shkreli thanks the Lord…

Because when a Republican’t commits a crime it’s all in the past and we need to move forward for the good of the country. The opposite is true when a Democrat commits a crime…

The prosecution is under no obligation to list possible indictments. Jaworski felt, after much negotiation, that Ford did indeed have the power to issue the pardon, and therefore refused to proceed with pursuing indictments against Nixon even after the pardon…though many were urging him to do precisely that. The thinking was, that it was time to put it in the past, and start the healing process for the nation. (Many disagreed then, and still do, btw).

Its probably also worth noting, that Nixon WAS listed as an unindicted co-conspirator in many of the actual cases resulting from the Watergate investigations. Though from my understanding, that is not an exhaustive list, and Jaworski was quite prepared to go forward with very specific charges against Nixon directly.

“Indeed, Jaworski had told Ford’s legal counsel, Philip Buchen, that the grand jury was virtually certain to indict Nixon and the list of charges could be lengthy and varied.”

As far as Kushner goes…I think we are getting ahead of ourselves. There are multiple reasons I don’t see Trump issuing any such pardon in the near term (or at all). One of the prime differences is, Nixon was THE target, in this case Trump is THE target. Nixon wasn’t going to be compelled to testify against his aides (those cases were largely already under way). Kushner would indeed to compelled to testify against the man who gave him his pardon. As has been pointed out many times, accepting a pardon is an admittance of guilt, and since the pardonee no longer has legal jeopardy for the crime, s/he no longer has 5th Amendment recourse…they have to testify.

I think they maintain their legal recourse to refuse to testify and trigger a contempt charge. A charge they are permitted to incur should they choose. The list of people that have gone to jail to protect someone, rather than testify to their detriment, is a long one.

Ok…agreed. But that contempt charge would not be covered by the pardon…since both the act and the charge happened after the pardon.

Theoretically, he could also decide to kill himself, or flee the country to avoid testifying…both of which would also be illegal acts.

So…they have no LEGAL way to avoid testifying. Only illegal acts.

There is a different law for rich presidential sons in law and everybody else.

Obviously. I merely was saying the pardon does not deny him other forms of legal recourse to resist testifying, albeit suffering consequences. Suicide or fleeing the country are options we all have, at any stage of any legal process or life event.

Bad news for Jared: Flynn pleading guilty to a lesser charge, Papado style. Full cooperation. They’re all going down.

He is pleading guilty to the charge. This means the entire Trump team is going to be under tremendous scrutiny from a witness with direct evidence because Flynn is a cooperative witness. Mueller could’ve put him away for 10-20 years. Instead, he’s getting a guilty plea (which a pardon can’t wash away btw) to the least of his charges.

If trump pardons him then the 5th amendment to not self incriminate goes away and trump is dead meat

Sentencing will be delayed, agreed upon and predicated on continuing cooperation with Mueller for a time frame of Mueller’s choosing, and requiring Flynn’s response to queries for which he’ll have no standing to ignore or fail to respond to. And Flynn will be legally required to be complete and truthful in those responses, or the plea deal is voided and additional charges can be levied.

Delicious in this newest development is the universal knowledge, shared by every single person in this drama, that Mueller doesn’t give a damn about Flynn. These new charges are like promising the buyer of a Maserati free floor mats. He knows he’s getting the keys to the car, the floor mats are a nothing burger.

Mueller didn’t just put Flynn’s balls in a jar. Those are Trump’s balls in that jar.
