Really, I’m hoping he’s not serious and this is just an attempt to show how ludicrous the Ballot Initiative system has become in California.
Someone asked me why this isn’t considered “hate speech, dangerous and obscene speech” and therefore not protected speech, even when formed as a proposition in a state ballot initiative. This craven and cowardly man is advocating the murder of a whole segment of the population, people engaged in lawful activity, and therefore he is threatening innocent people, inciting violence in the general public, and so a warrant should be issued for his arrest.
I could only respond to her: “Sounds good to me. But the slippery slope notion of ‘the regulation of speech also regulates ideas in the proverbial marketplace’ comes into play. In Canada, our good neighbor, he would be arrested. At the very least, he could perhaps get the psychological help he so desperately and obviously needs.”
God tends to have others do the dirty work, apparently.

There’s a small part of me that hopes that this gets to the ballot, and that somehow we’re able to FOIA (or state equivalent) the names of every single person who signed the petition.

“Any Californian can submit an initiative for the state ballot for a $200 fee, at which point the attorney general has 30 days to review it and allow circulation to collect signatures.” I’m curious what this review consists of. If she can’t reject it or modify it in any way, what is the purpose of the review? If she doesn’t review it, does it go into circulation anyway or does it stop there? It would be odd to have a step in the process that is completely superfluous.
As for rich usage of the English language, I think the bible is a poor example. It’s vague, archaic, and clumsy. We’d be much better off requiring children to read The Sot Weed Factor, Middlemarch, or pretty much anything by PG Wodehouse.

It’d be a variation on Stand your Ground laws, no? “This person was approaching me; he appeared to have the intent to willingly touch me for purposes of sexual gratification . . . what else could I do but perform my civil duty under California statute?”
I doubt it, Robertson would probably see this as appropriate punishment.
