It would be interesting to see the actual contract, the bank might be covered for this, who knows. But if the bank violated the contract, they should and will pay.

Iā€™m also thinking when the child is older, she will find out that her parents sued because they wanted an all white baby. Donā€™t think she will be too pleased about that.

If they did not want a half-black baby, they should have put it up for adoption when it was born. And at 5 months pregnant, abortion might have still been an option if they were that worried about it.

As to her insensitive family, Iā€™m sure as a lesbian couple they already hear a lot of nonsense from them. Iā€™d ignore them. If they are that bad, who needs them as family.

The lawsuit says Cramblett also is worried about how Payton will be treated in her ā€œall-white, and often unconsciously insensitive family.ā€

I hope this language is slightly exaggerated for the sake of the lawsuit. $50,000 would go a long way toward setting up a college fund for the girl.

As far as the predominantly white community and insensitive family are concerned, what an opportunity this is for them!

This is so tragic in so many ways. Most women who carry a child for 9 months have bonded with that child way before they know what it looks like or is and apparently they do love he, but I feel so sorry for that child.

Of course I recognize my own biases and viewpoints, but I question whether this article really rises to the level of ā€˜newsā€™.

Is there some subtle implication I am missing here?

Much to do about nothing. The attention deprived headline tries to give the impression that this lesbian couple is upset about having the multiracial child, which the story indicates that they love just as much as if it were ā€œwhite.ā€ The suit itself is modest and prompted more about the shoddy professionalism of the clinic and the desire that the suit itself will raise the level of that professionalism. Frankly the story and the headline seem to be something that one would expect from the Huffington Post.

One of the attractions and advantages of sperm banking is the opportunity to do some genetic selection you think is good for your family. These ladies were screwed. Racism is not the issue, though for the purposes of attracting eyeballs to this story, it works well.

Its as normal for this lesbian couple to choose a donor that resembles the partner as it would be for a heterosexual couple of any race. I would not expect people go to a sperm bank and just say ā€œSurprise me!ā€

Honestly, Iā€™d be pretty pissed off too. Put a dollar in the machine and press coke and get a pepsi. Doesnā€™t matter if youā€™d still like to drink the pepsi, your decision was cheated. Yes I just compared children to soft drinks.

According to you, they had other choices ā€“ they could leave their family and home, have have gotten a late term abortion or put the kid up for adoption. All sounds so easy and logical. That they chose to keep their baby and are trying to get help with the expense of counseling means they must be racist.

Easy to fix the problem with the parentā€™s familyā€¦stay away from them. Why would you subject the child, and from what she said about her familyā€™s feelings about her Lesbianism, yourself to that kind of ignorance. Is the couple going to tell the child that they sued the sperm bank because the child came out black? THAT will make the kid feel loved, eh? Their excuses for the suit says more about them then anything else. Funny coming from members of a group that are so ā€˜passionateā€™ about tolerance and acceptance.

Wow, thanks for putting the Sean Hannity type twist on what I actually said. When the HELL did I say they were ā€œracistā€, or even imply that? I first wondered what the Contract said. Then I wondered how the kid will feel when she finds out her parents wanted a white baby and SUED when they did not get one. Your take on that??? Yes, couples have 3 options for unwanted babies. Keep them, abort them, or put them up for adoption. They chose to keep it. Good for them. But for some reason now the kid is being dragged into a lawsuit, and that will be part of her history, ā€œI was the wrong color baby for my parentsā€. If this was such a big deal to the parents, they should have chosen one of the other two options.

I am also curious why they waited over two years to file this suit? Shouldnā€™t they have immediately filed the suit? What has changed since then? Hmmm, perhaps some financial problems have come about?

Exactly, well said. The way to teach acceptance is not to segregate, but to integrate. What a PERFECT opportunity to practice that. Seems to me these two are more worried about THEIR image than the childā€™s well being. And yes, the kid will definitely find out her parents sued because she was the wrong color.

I also wonder why it took over 2 years to file the suit? Have they fallen on hard times, and now are looking to make a few bucks? If I was that mad, Iā€™d file suit immediately.
