No one need have any doubts, concerns or uncertainties about what Gorsuch is now or would be on the Supreme Court - a too clever by half, smarmier version of Scalia. His uses the trademark obnoxious slight i.e. Democrat when the proper form is Democratic and note the ending of his noxious - let the driver freeze decision - (paraphrasing) - You can write your own statute and adorn(!!!) the Federal Statutes with it. Yeah, he is going to be one giant piece of work for an unfortunately long period of time. The at least one Trump âgiftâ that will not go away.

Am I the only one who finds the layout of reportings of hearings (from top to bottom most recent to least recent instead of least recent to most recent)?
With most recent to least recent I have to scroll to bottom and then read up instead of simply reading down. Anyone else find this hard to read?

While the cloud of illegitimacy hovers over the White House (investigation of Russian ties, violations of the emoluments clause, etc.) no nominee of Trump should be considered. Period. Every Democrat should vote no on every nominee until the questions about the White House are cleared.
(Obviously I know that this means that no Trump nominee will ever be considered.)
Legally, Garland is still the appointee for that seat on the court. The Senate has just delayed performing their constitutional duty to advise and consent. The constitution also states that all communications from Congress must be in the form of vote tallies. Not doing something is not communication from the senate. So, Garland remains the appointee to the court until the Senate takes a vote and reports that vote to the president.

Yes, that means it includes John Roberts, Samuel Alito and Clarence F. Thomas (you can figure out what the F. initial stands for). And a richly-deserved unanimous reversal it was, too, of a heartless POS decision.

In reading the tortured, pretzel logic (no offense to Steely Dan) penned by the judge in that case, it occurred to me that the driver deserved to win the case. First, the statute and subsequent regulations expressly forbid the employerâs firing of a driver that ârefuses to operate a vehicle because ⌠the employee has a reasonable apprehension of serious injury to the employee or the public.â Indeed, considering that his employer specifically gave him the option of firing up the engine and literally âdragâ the disabled trailer, rather than abandon it to avoid freezing to death. His refusal to follow that irrational (and dangerous) option should have been enough, even for Judge Gorsuch. Any judge that cannot bring him-/herself to appreciate the health, safety and public welfare intent of the statute in this case, desperately needs a transplant or two.
