Can someone explain the downside FOR TRUMP to declaring an emergency? He is clearly resisting it, which means there has to be a personal cost for him.

If Trump tries the “national emergency” gambit, he will be taken to court and lose. He can then have another target for his ravings, but he will still lose.

So-called “conservatives” (they’re nothing of the sort; merely whores) are against such a move because if the courts allow it (they won’t), all sorts of national emergencies may be declared by future Presidents; especially the wanton gun violence that plagues this country.

Trump’s ploy will fail, even if he goes through with it.

Nancy Pelosi crushed him on this. Taking back the House in 2018 may have saved the country. Voting “D” does matter in a country where the two-party system is as entrenched as it is here. Even the “lesser of two evils” matters where incremental change can be overwhelming when measured over time. And such incrementalism usually leads to seminal moments when radical change becomes manifest.

Congress needs to simply rewrite the National Emergencies Act and take that power away from him, preferably yesterday. I suspect that by now many Rethugliklans would be interested, if not willing, to do so.

Maybe some of his lawyers are saying they’d quit? Or that it would result in (most likely) quick judicial repudiation – imagine a lawsuit by a Tx rancher whose properly is being confiscated for a decreed, legislatively unauthorized faux emergency wall. And even if successful, would result in a precedent that would loom large the next time there’s a Democratic president?

That’s what I believe. I believe that if GOP had held the House in 2018, we’d never again have an even remotely-fair election. As big a tipping-point for the nation as Lincoln’s re-election.
