Whitaker attempted to exonerate Trump long before he could have weighed the evidence gathered by the Special Counsel. Trump would like us not to recognize Whitaker’s actions for what they were: prejudice and partisan hackery.
I don’t know if Wallace pointed out any of this.
My cynicism and my general distrust of the conservative justices who now dominate the federal system do not allow me to be as optimistic as you.
28 US Code §508(a) says “In case of a vacancy in the office of Attorney General, or of his absence or disability, the Deputy Attorney General may exercise all the duties of that office,” (emphasis added) I have complete confidence that the DoJ will argue this is permissive, not mandatory.
§508(b) says “When by reason of absence, disability, or vacancy in office, neither the Attorney General nor the Deputy Attorney General is available to exercise the duties of the office of Attorney General, the Associate Attorney General shall act as Attorney General.” Unlike 508(a) this section is mandatory but the DoJ can argue that Deputy AG Rosenstein is not absent or disabled and the office is not vacant, therefor the conditions precedent have not been satisfied so this section never comes into effect.

She was with me I think a long time, I know that because she had two I think maybe even three of my babies, but it was never really clear where she came from her last name sounds pretty foreign I’m not sure what all she did but I think she must have done a pretty good job because we kept her on so long. Marple, Maple, Mapes something, she wasn’t with us all that long, not real productive, I think maybe one baby, anyway it wasn’t a great fit. Melody’s been with us through a lot and I mean a lot, I don’t know if you’ve seen her she really does a nice job of keeping herself in shape so we’re reasonably happy with her. My father I knew pretty well but the woman, we weren’t that close, I think she wasn’t completely with me and I was never really sure how loyal she was. Their other kids, you know I really never knew them all that well, we had some disagreements but mostly we got along I think. I don’t actually remember ever meeting Matt Whitaker, Matty Boy they like to call him but I liked his name, a lot, so it made sense he had to be a top lawyer, the best for this job.

Not only that, there are multiple provisions and statutes that (arguably) can be applied.

But yeah, it is tired and devoid of any meaning to the entire population except for Donald Trump and his cheerleaders/water carriers over at FOX.
We’re fortunate that he’s too messed up to understand what he is and still does these “interviews.” More records of this insanity are better than less.
Trump has always had a fixer in his life, and we know that Michael Cohen was his. So sometime during the campaign someone got through to Trump that bringing Cohen to the WH would not be a good idea. That left Trump in a pickle because he needed someone he trusted to handle certain things, and some of those “things” would be to find out about who so and so is and bring them to Trump’s attention.
So who nixed Cohen, and who is the WH Cohen?
If he didn;t know about Whitaker’s bias then that is a clear admission that he did not vet the guy at all. Even a little bit. The alternative (which I believe) is that this is a total lie and he knew of the bias since it was nationally broadcast on CNN and other outlets (including Fox). Since he was aware and has now lied about it we have ‘corrupt intent’ established for this obstruction of justice.
Which nearly every upper middle GOP voter knows - they’d never hire him in a million years for their own company because they know he’d run it into the ground.
But tax cuts.
