If I remember correctly, the ACA was one of the issues that turned things blue in the last election, especially in some of those red areas where people came to the realization that there isn’t a replacement to be found. While the maladministration will blame it on the courts (should it succeed) they are backing it, which is another campaign point for the next election. Let them die on this hill.

No, you miss the argument in the suit. The plaintiff’s argument is based on the amendments to the ACA that reduced the “freeloader” tax to zero. They argue that that amendment killed the only constitutional support for the ACA. Here is how the argument goes: The only Constitutional basis for the ACA is the constitutional power for Congress to levy an income tax. It is this power that made the Social Security Act constitutional. And it is the only way that the Supreme Court found the ACA constitutional. So, if the tax basis of the ACA is eliminated, then the constitutional support for the ACA goes away. Poof! Now if the Democrats had any strategic sense, let alone any gift for plot lines and story development, they would be having nationwide hearings on the ACA and the Administration’s attack on it. But they don’t. There are plenty of good arguments against this lawsuit, including all the statements by Republicans at the time the amendments passed, so the Democrats in nationwide hearings could be wrapping those statements like a noose around Republicans throats. But they are not. The Democrats think that the Maquis of Queensbury sets the rules for American politics. The Republicans - especially the Trump Republican Party - know it’s Fight Club. There are no rules.

There is no ruling from the Fifth Circuit. There is an appeal from a District Court pending in the Fifth Circuit and the Trump Regime, through sober, sensible centrist AG Barr, has filed something or other in that appeal indicating it has changed positions from the one it advanced in the District Court and now urges affirmance of the case it lost below. Raising the question, of course, of who is going to be opposing the ruling on appeal.
This is fantastic news because it is indeed upon healthcare that the Dems took back the House. All they have to do is stick to this theme, along with the fact that, indeed, the Repubs want to take away (or let’s call it also “privatize”) Social Security.
It sounds too easy, but, as the saying goes, nothing is so simple that it can’t be made into something extremely complicated. And the consultant class has a big stake in selling all sorts of polls, advertisements (remember they get a huge cut of TV ad buys) and all the rest to add all sorts of BS to the campaign. So they alone will be a huge complication if they are not managed by someone who isn’t subject to their foolishly self-serving advice. Get elected first, then invoke the need for higher teacher salaries and all the rest, Kamala, Bernie, et all.
The next election will be the Dem’s to lose, and lose it they will if they overreach and/or put forward another holier than thou candidate who acts like they are the most deserving person to ride in and save us (remember “basket of deplorables”). We need someone who is genuine and not full of themselves.
Well, I agree with you that the suit is “bogus” under normal statutory construction rules, but that doesn’t mean it will lose. It is precisely that fact that makes it such an obvious target for Democrats, but they are doing nothing to dramatize it, to make it a big issue in the public mind. There is absolutely no excuse for that, since they now control the House.
That would be true if everybody had voted GOP. But the majority did not. This is trump’s well known streak of cruelty being used on perceived Obama supporters. And on the legacy of someone trump hates. Obama belittled trump in 2011 at a media roast dinner and trump vowed to destroy anything associated with Obama no matter the collateral damage.
He is emboldened , and it does not bode well for affairs domestic and international.

It always raises my hackles when the majority of voters didn’t vote for donald & Co. Since 2016, I’ve said that donald’s election was a black-swan event. Your point may outweigh my opinion though, because those who didn’t vote, voted 3rd party and stayed home through laziness, did, in effect help elect donald. Those who didn’t vote because they didn’t want to cross the ‘picket line’ of trump militias or were intimidated in other ways – that group has my sympathy.
For a different reason than you, though, I say --> bring it! Obama care was a compromise based on Romney care and was a huge boondoggle for the Insurance Industry. Now the idea of single-payer, medicare for all, etc. is pretty well known. Obama care could have been fixed, but if the GOP kills it, they will make their base happy, even the dumb ones who day ‘keep your gov’t hands off my medicare’ etc.
I’m thinking that they will shoot their own feet if they do this. Let 'em do it & clear the way for a healthcare system that will be ven more beneficial for the people.
It woulda been nice had the trump people thought about the second half of “repeal and replace” but they could in reality care less. And the trump voter is more than happy to vote against their own personal self interest.

Death of Obamacare would probably rush the public option of Medicare-for-all as the patch… Which the House would pass overwhelmingly, and we’d be going into the 2020 election with McTurtle refusing to hold a vote, and millions pending loss of their health insurance at the end of the year…

Voting is not the only way to keep the government honest, ask the French, but yes they have to get off their tails.

Sticking to an overall theme of better health care is important for 2020, but there are land mines in the most extreme proposals like Medicare for All/Single Payer. And the Republicans know that. So we have to be careful.
Propping up the ACA and eliminating loopholes, reducing drug costs, all of those are winning issues. But if the Dems go all-out for single payer in the 2020 election, then Republicans will run ads about how anyone on employer insurance will lose their private insurer and be replaced by a government program, with all the scare stories about not being able to choose your doctor, long waiting times for tests, the whole megillah. The R’s have no replacement plan of their own, they never have. But they know how to scare people about those crazy socialists.
In an ideal world, this country would already have single payer system, along with the high taxes on everyone (not just the wealthy) to pay for it. No free lunch there. But until we boot enough retrograde asshole Republicans and lobbyists out of the government, it’s too early to make it happen.
