I lost all faith in SCOTUS when they crowned Bush President. I will let the lawyers who comment on this thread make the deeper points, but that decision plus Citizens United and Hobby Lobby have convinced me that there is no actual will among the conservative justices on the court to separate religion from government or government from dark money. These decisions are made based on political power and the justifications are thought up afterwards.

We have already been truly screwed by SCOTUS and McConnell, and the future is just more of the same.

Biden completely mishandled Thomas’ confirmation hearing. While bowing to lick Jack Danforth’s boots, he allowed the public humiliation of Anita Hill, Thomas and the rule of law. He felt so bad about the hatchet job that Thomas, Danforth, et al did on Dr. Hill, he felt the need to apologize after 28 years.

To think, this cretin and mental midget got Thurgood Marshall’s seat is even more infuriating to this old white guy. And no, I still haven’t gotten over it and don’t expect I ever will.

Yep, and Ted Kennedy sat there, not saying a word because his nephew was on trial for rape. Ah, the Democrats and their sex issues. Always way more important and damning then the constant financial, moral, and ethical corruption of Republicans. Too hard for the base to understand.

Yes, and I’ve always wondered how they square this originalism with Citizens United -the decision that gave corporations the rights of individuals. This language is not in the Constitution. That court created a right out of whole cloth.

That was more than a creation out of whole cloth. It required the Court to ignore black letter law that a corporation is a legal entity separate and distinct from its shareholders that exists solely at the grace of the state.

Remember how we have been appointing Conservative Activist Judges like the Dishonorable T.S. Ellis III, Daniel Mannion, Antonin Scalia, Samuel Alito, and Brett Kavanaugh? And there it is. The constitution interpreted essentially as a handbook for governance by the owner/rentier class.

The idea that America’s constitutional system might be fundamentally flawed cuts deeply against the grain of our political culture. But the reality is that despite its durability, it has rarely functioned well by the standards of a modern democracy. The party system of the Gilded Age operated through systematic corruption. The less polarized era that followed was built on the systematic disenfranchisement of African-Americans. The newer system of more ideological politics has solved those problems and seems in many ways more attractive. But over the past 25 years, it’s set America on a course of paralysis and crisis — government shutdowns, impeachment, debt ceiling crises, and constitutional hardball. Voters, understandably, are increasingly dissatisfied with the results and confidence in American institutions has been generally low and falling. But rather than leading to change, the dissatisfaction has tended to yield wild electoral swings that exacerbate the sense of permanent crisis.

It’s a good thing there are no activist judges on the SCOTUS. All those right-wing “originalists” at the Federalist Society, not to mention Opus Dei, would take a very dim view of such renegade politicking at the bench.
