He got summarily blasted in oral arguments with that line, when it was pointed out that what they were doing is driving Texas women to seek their doctors in NM, and he was ok with that.

The worst part is most of them are straight-up hypocrites. The moment little Suzy Jane gets knocked up by the second-string quarterback, they head for the nearest out-of-town clinic and get her taken care of.

“Abortion, as regulated by the State before the enactment of House Bill 2, has been shown to be much safer, in terms of minor and serious complications, than many common medical procedures not subject to such intense regulation and scrutiny.

Yes, that’s the way Federal Constitutional Rights work. The states don’t have the right to take them away. I realize people in the South have been a little slow over the years in grasping this, but the rule still holds.
