Other things which are plausible:

The Keebler Elf also got burned by the 2nd Circuit today as well. That appeals court (en banc) ruled that the Civil Rights Act of 1964 covers sexual orientation in workplace discrimination cases… something the Trump EEOC and Justice Department have rolled back.

SCOTUS doesn’t make a habit of overturning en banc rulings.
And the 2nd circuit isn’t the most liberal, either.

2nd & 4th have ruled the same way. 11th ruled against… so there is conflict to be resolved.
