I hate to point this out, but the league could institute such a rule (maybe not where a team gets particularly substantial public subsidy, but probably even then). The NFL and the teams are private enterprises, not public ones. An employer can regulate behavior on its premises, during working hours. It can, for instance, prohibit employees from wearing campaign buttons on the company premises.

The First Amendment applies to government, not private, intrusions on the right to free expression. It’s important to recognize the distinction.

That being said, Sessions would probably like a rule requiring players to wear white sheets and hoods.

Given that the NFL enjoys an antitrust exemption, Congress should be able to insist on respect for and extension of constitutional protections for NFL employees.
