If Whitaker is permitted to remain in his A.G. position without Senate confirmation for any job in the Trump regime, this means any president, not just Don the Con, can appoint any unqualified hack he wants for 210 day “terms”. Such actions could extend throughout an entire presidency. This nullifies the Constitution’s requirements for Senate confirmation and eviscerates applicable statutory law.

This is a big deal folks.

God I love this - we aren’t just renting apartments in DC and looking for drapes - we’re hitting the ground running hard. I love it.

Goddam, I hope this suit is well crafted.

Only the Trump White House would’ve thought there wouldn’t be blowback for this choice…

The best people, Jerry. The BEST.

Also, Whitaker is part Beluga Whale, so there’s that.

So when this happens, what is next? Where does the suit go next - and will an f-ing Trump appointee be the judge?

The first question raised will be whether these Senators have standing to sue.

Can they establish that without McConnell’s help?

Yes, and I suppose I should have said, I expect these senators to have already successfully wrestled with that issue. Can’t wait to read it.

Not only that, but does Maryland have standing?

I didn’t know that he’d been confirmed by the Senate. I understand the question, but can those expire? Is it anywhere in law or precedent?

Yes! Fight the fascists!

…we shall not flag or fail. We shall go on to the end, we shall fight in France, we shall fight on the seas and oceans, we shall fight with growing confidence and growing strength in the air, we shall defend our Island, whatever the cost may be, we shall fight on the beaches, we shall fight on the landing grounds, we shall fight in the fields and in the streets, we shall fight in the hills; we shall never surrender…

Kavanaugh was confirmed by the Senate for his Circuit Court appointment. That didn’t mean that he could then be elevated to SCOTUS without Senate confirmation. The Senate doesn’t confirm the nominee - it confirms the nominee’s appointment to a specified office.

It’s available.

(They try to address the “standing” issue in paragraph 33.)

Agreed. I have a feeling Trump and his enablers may already be planning who the next hack will be. One could imagine situation where they just flip back and fourth between two hacks.

Do not assume that just because someone is a PP appointee that they will automatically do his biding. Some of these folks are well aware of the fact that PP won’t be the last president and that he could very likely be replaced by a Democrat in just two years. The very last thing they’d want is to hand this power over to a Democratic president.
