Discussion: Scalise Doesn't Object To Trump's Talk Of Unilaterally Eliminating Birthright Citizenship

We can conclude that for some, including the President, the oath to uphold the Constitution of the United States is fluid.

Scalise is a member of the GOP. He voted to pass the tax scam bill that contained a provision to take away access to the ACA for some 13 million Americans. He is one of the legislators that deliberately harmed and/or killed some 13 million Americans. He is one of the legislators that deliberately ensured some tens of thousands of Americans will die preventable deaths each year. His near death experience seems not to diminish his vile and disgusting behavior and conduct.

Great news Mr. Scalise!

If trump can get rid of the 14th Amendment via executive order - then we can also abolish the second amendment once and for all!

I don’t think he’s trying to distract so much as he’s trying to energize Republican voters. One thing he understands probably better than anyone else is that the Republican Party base has one singular uniting principle-hate. Whether driven by fear, racial animus, ignorance, or anger, you can energize them by talking about scary brown people coming to get them. If anything, he’s trying to refocus them on the election.

Say that the DHS is instructed not to issue a passport without verification of the US citizenship of the parent. Say that a child born next month is refused a passport on that basis. One can foresee a legal challenge.

I am watching Jennifer Rubin right now; last night she and David Frum were on Lawrence O’Donnell and they make so much sense and they make so much sense. Then I remember how they ā€˜used’ to be.

This is not turning out well.

Ok, that is a legal dispute. I know that everyone thinks he can do whatever but he can’t.

Only if they are willing to say the constitution doesn’t matter anymore.

The Supreme Court would never endorse Constitutional amendment or nullification by executive fiat. The question is what would the SC do if the Constitutionalist-in-Chief were to issue such an EO. In his opinion in Heller Justice Scalia, a leading proponent of textualism, declared that ā€œA well regulated Militiaā€ was nothing more than rhetorical flourish before going on to divine the original intent of the 2nd Amendment. I would not put it past some of the conservative bloc on the Court to interpret the original intent of the 14th Amendment as being limited to the children of former slaves, but I doubt that even the current Court could reach a 5-4 majority on that issue.

Goddamn -thank you.

Doesn’t surprise me. Scalise is a dirty Nazi loving right wing terrorist sympathizer.

I don’t feel sorry for this POS anymore. Hope he’s in pain every day for wanting to attack Americans with his racist evil hate.

One thing that I think gets overplayed is the idea that the court will necessarily side with PP because they’re Republicans too. I think Roberts is going to end up being a swing vote in order to save his court and spare his legacy. Think about it. He’s the type I’d most likely suspect was a Never Trumper. Honestly, Kavanaugh strikes me as one too. Those Ivy League Conservatives sneer at the Trumpers. Doesn’t mean they won’t vote for regressive Conservative policies, but it doesn’t mean they’ll have his back either.

Scalise is stupid. Surely we can all agree on that.

Two? At most three?
Even Thomas, arguably the most conservative, was a ā€œfounding fathers intentā€ clone of Scalia, so not sure if he would join the radical party representatives, Gorsuch and Kavanaugh. But yeah, he wants to be part of the club. The others, not so much.

I really do not see it happening though. The outrage would be deafening- maybe Repubs would even grow a spine and speak out.

Maybe Minority Leader. The Speaker will likely be a Democrat

He gets shot up, is incapacitated for months, doesn’t get back on his feet without using crutches and his mantra remains ā€œMore guns.ā€ I’d say that’s stupid

He’s just amazingly stupid like so many of the GOP these days. They know nothing about the government and they are the government.

Amending the Constitution through Executive Order is about as far from the rule of law as you can get.

With six days to the elections moron is scheduled to hold something like 11 rallies, so yeah, gotta keep the topics lively and incendiary or the rubes would be disappointed.

It is and the only way they do this and have it stick is if they declare the constitution is no longer in force and effect. In other words, they go completely lawless because they can’t do it under any law except the one that requires constitutional amendment.
