Discussion: Sally Yates: If Trump Weren't President, 'He Would Likely Be Indicted On Obstruction'

So where in the constitution exactly does it say a sitting President can’t be indicted?

If the only reason you’re not charged with a crime is because you’re President, then…darn, it’s too bad I can’t think of what should happen next in a just society.

I suppose I should give Trump “credit” for being able to sniff out the tremendous powers of the Presidency, from his little rat brain, not to do good by Americans, but to shield himself personally from criminal actions. And then the accompanying bully pulpit to incite violence against his political opponents.

This raises the constant refrain of the last two years: “And his supporters will vote for Trump anyway.”

This is ridiculous.

If the Texas AG can serve while indicted then they indict the president.

I just want to see congress lock up (1) person who is refusing testify,They (Congress) needs to show some big onions here, these witnesses aren’t street folks and getting locked up will bring them all to the table.

Trump didn’t “sniff out” those powers. In his overwhelming ignorance, he assumed that Presidents could do whatever they wanted.

Trump hated Obama – and is such a narcissist that he assumed that the only way that Obama wasn’t charged with crimes is Obama’s power to thrwart investigations.

It is probable that Donald still doesn’t grasp just how much shittier his life is going to become over the next 18 months.

Congratulations on waking up from your coma! If you’d been awake, you might have noticed the dozens of articles describing DOJ “guidance” stating that a sitting President can’t be indicted. I wonder what else you’ve missed?

Thank you, Acting Attorney General Yates, for your continued service to the US.

As I understand it, the main argument is that indicting a sitting president would represent an impermissible interference by one branch of government, the Judiciary, in the day to day functioning of another co-equal branch of government, the Executive. First, I don’t see how an indictment alone would create undue interference, since the prosecution could be stayed until the president leaves office. Second, why do we have a vice president if not to step in when the president cannot perform the duties of his office (not that the idea of Pence as president is any less of a nightmare). Third, it cannot be that a president can’t be indicted, arrested and prosecuted if he commits some heinous crime in the White House (like murder), so why can he not at least be indicted for lesser crimes?

So in other words, NO ONE is above the law except a sitting president. Equal justice under the law… of our dreams.
