Pike County commissioners have already turned down the local probate judgeâs request that the county hire him a lawyer.
Several probate judges, including the one in Pike County, are refusing to issue ANY marriage licenses. I think most counties will follow Pike County and say no to probate judges who want the county to defend his/her not doing the job.
Good on them. They may have determined that the refusal was not something within the scope of the clerkâs duties. With luck, thatâll hold up if and when the clerk challenges the refusal in a court of proper jurisdiction. But it may not. Being wrong in the performance of duties doesnât make an action fall without their scope. Willful refusal to perform is another matter, but without examining the local [state] precedents, I wouldnât want to offer a definitive conclusion.
