There is no crime of misprision of felony–the failure to report the plan to commit a crime before it occurs any more. But you would think that this man might have figured that he should say something.

They will likely investigate this guy too. He might end up being charged if he was privy to such a plan and said nothing. But it has to be pretty clear cut due to law changes. He would have to have enough knowledge where it almost makes him a co-conspirator.

I don’t think it rises to the level of criminal culpability unless more comes to light, but the dumbfuck meter is pegged pretty far to the right.

And dbushik down thread hits on the more salient point, that this guys racist rants, talk about segregation, wanting to start armed violence against blacks, etc. was so “normalized” and excusable as “Southern Pride” as to not even merit telling anyone about it until after the fact. That is the real problem.

Right, they need documentation. If this guy was getting emails about the plan, etc., he could in fact be charged. Otherwise, not likely.

Actually, investigating after the fact will probably reveal that his plans were in plain sight all over the internet. The NSA probably missed it because they were so busy making sure that they were scooping up ALL the data, that they forgot to read any of it.
