I think it’s a relevant consideration, since we know that Trump is itching to can Rosenstein and Mueller, and his supporters are itching for him to do it. Since nothing is really gained by reprosecuting the mistrial counts - other than further squeezing Manafort, which is a valid but insufficient goal unless it causes Manafort to flip - I’m more concerned about the Mueller investigation continuing as long as it can and avoiding triggering events that could be used to “justify” ending the investigation. Continue with the 2d Manafort trial, continue investigating and continue indicting. But re-prosecuting the Manafort mistrial? Eh… And honestly, the bank fraud charge where the bank CEO knew that the statements were false but pushed the loan anyway because he wanted a position in the Administration? There’s certainly the argument that it was fraud on the bank as an entity, but it’s a tougher one to make because of the lack of reliance; if you know I’m lying to you, there’s no fraud. The others turned on some arcane point of ownership of foreign corporations, I think - did Manafort have the required ownership percentage. Again, arguments can be made, but I’m not sure it’s worth reprosecuting them just because, given the overall scope and needs of the investigation as a whole.
