People who have been denied marriage licenses by Kim Davis because she can’t give them out because it’s “against God’s Law” should sue her because she’s forcing her religious views on them.

Her right to her job exists only as long as she faithfully performs the duties of the office. She has no right to not issue marriage licenses. That’s part of faithfully performing the duties of the office. That’s the line she has crossed. Obviously if she had let her assistants issue the licenses, none of this would have been necessary.

Over the weekend I was visiting with a friend who lives in the area and knows Kim Davis and her family. He also has some tangential involvement in the proceedings there in Morehead, but I’ll have to leave his involvement at that (suffice to say, he knows the people involved and has a very good handle of what’s going on).When we talked about what was happening, he never said “Kim Davis,” but just “Kim.” Maybe a small difference, but it was a bit humanizing (I’ll also add that my friend completely disagrees with her refusal to issue marriage licenses, both legally and ethically). But more importantly, I brought up the notion that’s been floating around that Kim’s just waiting to cash in like so many other “persecuted Christians” have over the last few years with GoFundMe pages, speaking gigs, etc. My friend strongly disagreed with that, saying that Kim wasn’t getting anything (and probably wouldn’t), and that the people making money off this circus where the lawyers at Liberty Counsel. So I was glad to see that line of inquiry in this article, and I hope that TPM and others will keep looking down that road. It seems like Kim is someone who had some hard years, found a particular form of fundamentalism to grasp on to (not uncommon here in Kentucky), and got in over her head when she decided to take a stand. But pretty much everyone (particularly any lawyer with two brain cells glued together) knew from the beginning that she had no legal defense here. I really do wonder if the folks at Liberty Counsel have provided counsel more serving of their interests (and financial gain) than those of their client, Kim Davis. In other words, is Kim another victim in this clown show?
