It may not be a bad thing for us to get away from “judicial activism” — defined as determining law through judicial rulings — and get back to building a liberal legislature to make laws that conservatives must follow. If the judiciary “goes Scalia” and starts making up interpretations, the solution is to legislate their creativity away.
There’s three branches. We can own two pretty quick.
It’s certainly hard to read the news each morning and try to keep your spirits up, but perhaps things would feel a little different if you realize just why these odorous people voted from Trump and why their representatives are trying so hard to remake the world - it’s because they realize they’re running out of time.
Another way to express this is to point out that these people are pissed, and the reason they’re pissed is that after a generation of fighting, they actually lost the culture wars. As a kid growing up, my mom took us to Civil Rights marches; throughout my teens and twenties, the dominant theme was Women’s Liberation; then it was discussions about the changing palette of America from white to multi-culturally multi-hued; the last ten years or so, it was watching one state after another legalize Gay Marriage, until one day, the entire map flipped and you could drive a car from New York to California and every state you passed through was a “it’s legal here, too” state.
I strongly believe that this is the absolutely dominant reason Donnie got elected - those who opposed all these social movements realize that they lost and they’re pissed and just want to lash out. But, (and here’s the but), they lost the Culture Wars because they’re not the majority, and their numbers are shrinking by the day.
Sure, when they lashed out they just happened to get lucky at just the right moment. A supine media, a complacent electorate, a few too many Susan Sarandons and Jill Steins (mixed in with a healthy dose of Putinesque interference and Trumpian collaboration) sufficed to drop us all into the deep end of the pool. We’re going to have to come up for air, and then we’ll have to paddle around for a bit, but if the past 50 years have taught us anything, it’s that we all know how to swim.
For now, just watch the bubbles (they’re rising to the surface, so just follow them up!) Once you reach the surface, look around and start swimming towards the shallow end of the pool. And once you get to the stairs, climb on up and shake yourself off. You’ll find lots of other folks there with you and we’re all pissed as hell, this could be fun once we’re all ready to move.
And don’t forget to help out those around you along the way!
Remember, no matter what - these odious creatures are still a shrinking minority, Donnie’s polling at 38 percent approval (and falling) and the “Gang That Couldn’t Legislate Straight” have, to date, still failed to passed anything more than a couple of Post Office name changes. Could they still do damage before we show them the door? Absolutely, but we’re the majority, folks are now wide awake, we’re a lot more aware of the consequences now and I really do believe that we’re going to stir folks up over the next year or so.
Now, it’s not a slam dunk - Roy Moore might still get elected in a couple of weeks, but that fact that we’re even asking whether he might actually lose is an indication that we’re in the midst of a fundamental sea change in attitudes. Let’s move towards the light, and let’s not lose sight over just how far we’ve already come…
That’s actually what the SCOTUS is supposed to do. Anyone who calls it Judicial Activism makes me suspicious. Courts have the power to determine laws - what do you think their job is?
1000+ likes. Excellent. I agree with you. Things are not getting worse, they are getting better. We are winning this war, now is not the time to take to the fainting couch. We all have times when we get down, when we see the damage inflicted and feel it is hopeless. It is not hopeless. Any damage can be corrected. America has taken a hard hit, but we can learn from this and continue to move forward. We are the majority and we are coming on strong.

Wish there was some way to justify refusing to fund hurricane recovery money to districts whose reps voted against funding recovery after Hurricane Sandy.
Also, too, isn’t it too soon after the terrible tragedies of the hurricanes to even talk about maybe doing something about those events?
