They don’t hand out Harvard Law Professorships out of Cracker Jack boxes.,…and a man like Tribe would never be publicly speaking on this matter unless the matter truly is unsettled.

Except that passage only applies to ambassadors on assignment. It also only mentions allegiances through the father, not the mother. Back then there was a difference.

I am on less firm ground on this one, but I think there is a difference between common law and statues. One of the criticisms of the Harvard Review Journal piece was that it used statutes and not the common law upon they were based.

That makes Cruz a citizen naturalized at birth, not a natural born citizen. He must be a natural born citizen. That is defined in the Post article and the author describes the thinking of the Founding Fathers at the time.

With that government shutdown stunt (to further his political fortunes), Cruz caused people to lose jobs, savings, LIVES.

IF he were to be knocked out of this Presidential race, this PARTICULAR “Karma” would be analogous to Gacy getting parole after three years.

My Dad was in charge of a crew searching for oil in the Argentina outback during WWII. My Mom went with him and she got pregnant while there. They discussed her going to Buenos Aires to have the baby but were concerned that if she had a boy he might be eligible for conscription into the Argentinian military. So at about 6 mo. pregnant she made the journey by ship back to the US and had me in Michigan where her sister lived. I have never lived in my “home town” except for the few months after my birth until my parents were ready to move to a permanent home in Tulsa where the headquarters of my Dad’s company was located. After the relentless attacks on Obama for being a “Kenyan” I am enjoying this “karma is a bitch” moment for the Cruz person.

I love when South Park does the Canadian thing. It makes me laugh every time. I love that their cars have square tires…haha! It absolutely makes no sense, but it’s brilliant at the same time!

Agreed, and for the most part, most folks here maintain an appropriate consistency in how they view the law.

it is too fun to resist stirring the pot some, but mostly this is for fun amongst like minded folks. Some of us may like to dip into redstate to do some stirring, but again this is more about throwing their own arguments into their fray for them to bat around. if this foments duschord in the GOP, then that is ok too.

Thanks. I’m not a constitutional scholar, not a legal expert, and I’m not arguing either one way or the other, I just honestly want to know the answer… and it’s not about Cruz per se (who has disqualified himself for a whole lot of other reasons already).

The Constitution says that anyone born in the USA is a citizen of the USA. Therefore, it follows that anyone born in another country is a citizen of that country, as far as the Constitution is concerned, and it is only the Constitution that can define the requirements for eligibility for President.

Since his mom was a citizen and his father wasn’t, and he was born in Canada, the US naturalized him at birth. He did not have to go through the process he would have had his mother not been an American.
