Would if he could but he can’t. Only Congress can do that.
“any prejudice that Defendants now face is partially of their own making.”
Wait, is he saying that “they” are all alike? Actually, it’s self-evident.
““is becoming difficult to avoid seeing that which is increasingly clear.””

I assume the Census Bureau is funded through an appropriation, which is in a bill, which Trump can veto. And anything Trump vetos is safe from an override, because too many Representatives and Senators are too chickenshit to defy Trump by overriding one of his vetos. So, Trump can effectively defund the Census Bureau by vetoing their funding, right?
Yes and no. Yes he can veto it but it would no doubt be tied into an omnibus appropriation that funded so many other cherished programs (read: Military) that he wouldn’t. Just sayin’.
Not enough for Kavanaugh, Alito and Thomas.
So he demands Congress decouple the Census funding from whatever bill it’s within, because damn it, he wants to protect the voting rights of Americans and he won’t stand for a corrupted Census!!
The Constitution is pretty clear that the census shall be made in such manner as Congress shall by law direct, so a Trump veto would be a blatant violation of a constitutional mandate. Not that he would know or care.
100% agree! It’s like talking about a “bi-weekly meeting.” It can mean either twice a week or twice a month. In the case at hand a lot hangs on which meaning of the phrase is being assumed. Is the conclusion said to be indeed likely or somewhat improbable?
What’s the update on Dem CongressPeople in favor of Impeachment Inquiry?
Anyone?
Congressman Jim Hines came out in favor of an impeachment inquiry today. 76 Dems + Amash = 77.
You hit that one out of the park
“is becoming difficult to avoid seeing that which is increasingly clear.” is a phrase that really disturbed me because it sums up the media and the government denial over the last few decades. The “normies” are all trying to avoid seeing that which has been endemic since the founding of the country and is inherently obvious to every POC and anyone else who has achieved rational thought.
Why are we struggling so hard to not talk about the racist elephant in the room? Is it unpleasant? Is it too much trouble?
We still see stories every single day (from “objective” news outlets) that deny or downplay the racist aspect to all of this ugliness that has saturated Republican politics since Nixon and Reagan.
So, yeah, I guess for some it is becoming increasingly difficult to avoid seeing.
He could try to declare another national emergency and reappropriate the funds. His crack legal team will tell him it’s a “great-idea-but-possibly-not-and-I’m-not-being-indecisive.”
Punting would be a great outcome as far as I’m concerned. It would send it back down for reconsideration in light of the new evidence. That would, regardless of the ultimate outcome at the trial, appellate and SCT levels later, make it impossible to add the citizenship question to the upcoming census. And that would provide 10 years for some sanity to return to the country.
The same way the law says that the IRS shall provide tax returns on demand…
A federal judge in Maryland on Monday explained why he wanted another look at potential racial animus behind the Trump administration’s census citizenship question, with an opinion that said it “is becoming difficult to avoid seeing that which is increasingly clear.”
…
“As more puzzle pieces are placed on the mat, a disturbing picture of the decisionmakers’ motives takes shape,” Hazel said in his opinion Monday.
This is what I don’t understand about some people.
The judge is just now realizing what a lot of us have been seeing.
How much of this is due to “by the book prove it beyond reasonable doubt” and how much is due to denial as defense mechanism i.e. don’t want to believe the institutions you’ve dedicated your life to are being used for evil?
Cc @tierney
Now that is the kind of crystal-clear phrasing I’d like to see more of.
Woke up on the Eeyore side of the bed today?
“on his path to adding a citizenship question, Secretary Ross bulldozed over the Census Bureau’s standards and procedures for adding questions, at times entirely ignoring the Bureau’s rules,” Hazel wrote, “any prejudice that Defendants now face is partially of their own making.”
Unfortunately I do not think enough on SCOTUS care about Laws and Rules.
Such deception by our so-called “leaders.”
