I know they don’t care (the distraction is all that’s important) and probably procedurally have the control to move forward regardless, but they realize that nothing Obama has done can be considered “high crimes and misdemeanor” or even against the law, right?

In Napolitano’s defense, he also called for the indictments of Bush and Cheney. Of course he waited to do this until they were out of office and he had a book he was trying to promote to sympathetic far-lefties and libertarians. [Edit: he also made those specific comments to Ralph Nader and somehow forgot to suggest indictment of Bush/Cheney on his own home channel. Real profile in courage that one.]
This also isn’t the first time Napolitano has talked impeachment. Back on February 26, 2013 he appeared on Fox and Friends to claim that Obama’s implementation of the sequester was “almost an impeachable offense" suggesting that it was possible that “the president is deciding how to spend money in order to hurt us.”
Can’t they just get John Yoo to write them a legal brief in support of lynching and skip this intermediate impeachment hassle with all its legal mumbo-jumbo about articles and reasons?

I would add that he is correct that this lawsuit will be laughed out of court for the reason he gives…there is already a process defined in the Constitution for Congress to follow if they have issues with the President.
Which is why Boehner saying its not about impeachment when he first brought this up was so laughable. Pretty much everyone, including him, knows that the courts response will be “If you have an issue with this, impeach him”.
Boehner is just going through the motions to gin up outrage in the base and then he can play(?) dumb afterwards and say…“Gosh, well if the courts say thats what we have to do, then its what we have to do”.
Essentially, the lawsuit has always been about getting the Courts to weigh in on the matter of impeachment before they actually try to start the process.
I’m pretty sure that’s Obama wearing a very realistic latex Napolitano mask talking impeachment.

Judge Napolitano makes a very lucid and persuasive case that Obama should be impeached if he had any knowledge of the CIA spying on the Senate Intelligence Committee investigating CIA torture.
The president’s agents have lied to Congress and have spied upon it. If Brennan did not know about this, he should be fired for incompetence and for failing to control his agents. If he did know about this, he should be indicted for lying to Congress, because he denied it at a time when he had a lawful obligation to be truthful, and he should be fired for his failure to communicate a violation of the Constitution to the president. If he did tell the president that his agents were about to spy on Congress and the president failed to stop it, the president has committed a serious violation of his oath to uphold the laws and violated the separation of powers by invading the privacy of a coequal branch of the government—and that is an impeachable offense.
