Actually Obama does have the Constitutional power to send Congress home until such time as he thinks appropriate and there’s not a damned thing they could do about it. Article 2 Section 3 in part reads: “…he may, on extraordinary Occasions convene both Houses, or either of them, and in the Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such time as he shall think proper…”
But more importantly as was published here on TPM both Reagan and Bush used EO’s in regards to immigration with nary a peep from Congress.
