Oh, I think they can find countless weaker arguments, especially since their entire goal is to delay, delay, delay the truth coming out. Weaker arguments are going to be smacked down as quickly as this one, though - tough shit for the abomination and the fascistgop.
No, goddammit. This is not a “win” for Democrats. It isn’t partisan investigation for the fun of dumping on your opponent a la Benghazi. This is some serious shit that demonstrates that a con artist who treasonously worked with an enemy power and collected money from people under the thumb of its dictator cannot evade justice forever.

Deutsche Bank apparently already stated they are planning to comply. Presume any time before they actually do and it all becomes moot, Trump’s lawyers could file emergency appeals.

“Some say this proves that the Trump administration is lawless,” Mr. Barr said in a speech on Tuesday evening to the American Law Institute. “Not surprisingly, I disagree.”
The press too often treats this sort of thing as if it is a game or a sporting event. The consequences of being able to hold this lawless administration accountable, or failing to do so, are far more important than all of the Superbowls that have ever been held or will be held. In many cases, standing back and recording the events of the day as a matter of record is a useful service of the press. In other cases, however, the press is much too hesitant to take a side even when that side is obvious and not merely a matter of the party that approximates it. This is not “The Voice” or “American Idol” . . . this is the fate of the country. Have the courage to take a stand.
But what is the significance of the stay - and denying it?
A stay would have meant that the Bank can’t supply documents until the case is resolved.
Denying the stay means they could shoot them over five minutes from now.
Language is important. The media including TPM keep framing this as Democrats vs Trump or Democrats vs Republicans. It is really the administration defying the rule of law and congressional oversight. It should be framed that way.
If you don’t believe you have a strong argument to make that has any chance of prevailing…then yes.
Because the strategy becomes one of not winning, but simply delaying everything for as long as possible. In hopes that some external issue arises to change the calculus…like the client dying of a heart attack.

I have to think that Toobin misspoke in this instance. This was the best argument Trump’s feckless legal eagles could cobble together, and it has been shown to be a howler. There is no stronger argument coming, any more than there is a magic pony waiting in the wings.
It means the subpoenas are enforceable immediately.
If the banks comply—as they must do legally—any appeal is moot.
And the public likes a contest and sporting event with a winner and a loser. Don’t ever forget the press is a business and must appeal to the public to remain in business. With only a few exceptions, they are not a public-spirited non-profit.
I guess Trump doesn’t realize this isn’t like bleeding out middle class contractors in court to make them settle for twenty cents on the dollar. He’s brought his same miserable game to the big leagues, where his opponents can more than match him dollar for dollar, and inevitably have the better attorneys.
