Discussion: Inside McClatchy's 'Vigorous Defense' Against Nunes' 'Baseless' Lawsuit

We’re working to oust LaMalfa in District 1 so that would make 5!

Curious… Was there ever any reporting as to what charity was to benefit from this fundraiser at the winery? I mean, with the designated entertainment being cocaine and prostitutes, you’ve got to wonder about the charity being so “honored.”

Ummm, just how exactly do you “Serve” a virtual character who only exists as a Twitter account?

Nunes is textbook proof of the “Dunning-Krueger Effect”.

…and all his COW towing to Hannity

Law suits - How do they work?

Udders - How do they work??

It seems clear to me that the “lawsuits” were created purely for the news-bite and fundraising effect. They haven’t served the defendants because they have no intention of bringing the suits to trial. They just wanted a big headline and to rake in the sweet, sweet rube cash.

Though it seems unlikely that Nunes is the “mastermind” of this operation as your second sentence is a fact not in contention.

The obvious response:

Can the paper ask that Nunes be required to pay its legal fees in this case?

Especially given that while Nunes did not bother to serve the paper, he went on a fund-raising tear after publicizing it?

That’s a Cambridge [our fair city], MA law firm.

Failure to litigate can be cause for dismissal, and I certainly think a failure to serve is a failure to litigate. If I were representing the defendant, I’d advise going after the lawyers on disciplinary grounds, and countersuing Nunes on defamation and whatever other theories I could come up with. Destroy him by piling up his legal bills and draining his time. Depose him for days.

Oh, and the countersuit should be filed in California.

the publisher’s lawyer intends to file a motion to dismiss the case — if Nunes ever actually serves them and takes the case to trial. (Mair confirmed to TPM that she also has not yet been served by the lawmaker).

It’s a new legal strategy for the GOP legal activist analogues to James O’Keefe. It’s the Catch & Kill Lawsuit.

Here in CA17 we took CA22 as a sister district. Did alot of postcarding, voter reg, & phone banking for Janz against Nunes. I think alot of those folks will rally again!

Lawsuit as fund raiser. I am not a lawyer, but aren’t there rules against such frivolous lawsuits? And doesn’t the GOP detest them?

You can read more here. Alpha Omega winery claimed to know nothing (…NOTHING…). I admit to be curious how much of the winery’s business revolved around selling these fundraising packages, though.

ETF a stupid grammatical error.

It’s udderly frustrating how low Nunes will go.

This looks and smells like a fund raising stunt. We hope the Virginia court applies the California Anti-SLAPP laws and make Nunes pay every nickel of the defendants’ attorneys fees.
