The “pro-life” position is very tricky here. Assuming that most of the pregnant women that would be detained conceived while in the US, the “pro-lifers” would have to view the fetus as a US citizen and the woman as an immigration violator.
So, the fetal citizen should be free to go.
Immigration advocates might argue that it is in the interest of the fetal citizen to remain with the pregnant woman, and demand that she be released along with the fetal citizen.
That would never do.
Perhaps an advocate for the fetal citizen could argue that the woman is an unfit parent. She is keeping the fetal citizen closed up 24 hours a day in a space so small that the fetal citizen can’t even stretch its limbs out to full extension. The space is also hot (almost 100F) and humid (100% RH), but has no ventilation whatsoever. A judge could hardly rule anything other than removal of the fetal citizen, by force if necessary, from the woman. That should keep the “pro-lifers” happy without giving an inch on immigration enforcement.
While I would like to see reactions to implement your suggestion, I think I’d rather see the tizzy caused by litigating the idea of citizenship at conception. Particularly in the context of prohibiting the involuntary exile of a US citizen who is, through no fault of their own, still gestating.
