Pleading the 5th is for testimony, not records. I don’t think Flynn can ignore a subpoena for records?

It is still pretty faint, almost invisible, but I do believe it is growing stronger … see that over there Pennywise the President? That is the writing on the wall. Take note, it grows stronger and bolder each week.

Flynn’s company’s records may be subpoenaed, and surprisingly they can’t take the Fifth because they’re not people. My friend.

Can a murder suspect refuse to turn over their gun for ballistics testing, based on their 5th Amendment rights against self-incrimination?

I’m pretty sure the answer is “no.”

Why would it be any different for a suspected white collar criminal and their potentially incriminating documents?

Is there in fact any precedent supporting Flynn’s lawyers’ position that the 5th Amendment allows him to refuse to provide documents, or would this be considered a novel interpretation of the 5th?

Nance is so right and it’s what they’re investigating, Trump, associates, as stooges. Maddow last night – they are on this. But the money trail – I fear they will do anything to wipe evidence like Treasury. The recent internet hack, the promise of more. How convenient to breach and destroy US gov agencies.

You know, I smell a Supreme Court decision looming in the next few years that holds corporations will have such a right. “If corporations have a First Amendment right, why not a Fifth?” (Then down the road, a Second?)

The walls are closing in fast.

  1. Flynn looks like he has no choice but to give up Trump and Pence if he wants a deal. I thought Brennan’s statement that the CIA independently collected its own evidence and used that (and not the Steele Dossier) as the basis of the criminal investigation referral to FBI was probably the worst news of the day for Team Trump. FBI may not need to give Flynn a deal (or even a favorable one) if their own direct evidence is solid. Flynn has little choice but to draw attention to how he acted on Trump’s instructions and Pence’s tacit observance and approval. Otherwise, he’s facing big time criminal liability.

  2. Brennan also created a prisoner’s dilemma problem for Trump collaborators. Now that Brennan has implied in a thinly veiled way that the FBI has evidence against all of the Trump collaborators, those traitor Trumpers will look to cut deals. Their lawyers will have to advise them that they should assume the FBI knows everything. The lawyers are duty bound to represent their client and keep him/her out of jail or get the best deal possible if that can’t be avoided. They will likely all talk. I have a difficult time believing that people will do jail time for Trump. He’s the worst mob boss ever.

  3. I also suspect that Kushner is talking to the FBI (again I suspect, no proof). My gut instinct tells me that the Kushner family will not want to do jail time for Trump as Kushner Sr. already served time. Kushner is so wrapped up in money laundering and direct contacts with RU mob figures and likely government figures, and he is as brazen as Trump. He’ll talk.

  4. Mueller got cleared by DOJ to fully investigate the Trump WH. If Mueller is in the house, everyone is going to talk. No one is going to mess with him or fall on a sword for Trump.

What would accelerate matters is if Quist can beat Gianforte in the MT-AL special election and/or if Ossoff can win in GA-6. Right now, I don’t think the GOP health bill or budget bill would pass both houses of Congress. With that prospect looming large, I can see the political cover up wall around Trump beginning to crack.
