Legal question: If Mueller is subpoenaed, can DoJ still keep him from appearing, despite his personal liability for failure to appear?

What we do know as a Law of Physics is that this DOJ and this White House will try. If for no other reason than to play out their clock.

Likely no personal liability for DOJ employees who are directed not to testify under cover of “executive privilege.” Employees have no authority to waive this privilege.

Why the breathtaking drama on every single aspect if this sordid saga? Just as Barr KNEW Muellars letter would become public and he still applied bullshit- o- rama to the process, the full ramifications of the report are going to become known.Muellar, if he continues to be hamstrung by the DOJ should resign and get on with slashing the Barr created Gordian knot.Failure to do so simply perpetuates the question of who’s zoomin’ who…

I think the Pukes know tRump knows how to kowtow McGahn from appearing even though he could if he wanted to. They know they can’t do that to Mueller when he becomes a private citizen. He wouldn’t let them get near him to compromise what he has to offer by way of testimony, I believe.

Because the way I read the article the fact that he is still employed by the DOJ allows them to prevent him from testifying

I understand that. But really, why should he have to quit in order to respond to a Congressional Subpoena? I have been reading the newspapers since the 1960’s. I don’t remember a single Administration that forbade or prevented DOJ officials and employees from attending and or producing documents. The fact that this Administration continues to obstruct justice in public is not, in my opinion, a reason for Mueller to have to quit.

Firstly, I don’t disagree… if we were not where we are today, I don’t think it would be necessary.

However, with one of the 2 political parties having now gone COMPLETELY rogue, I don’t think there is any other way. If it really is that the DOJ can prevent him from testifying, can you honestly say that you think Barr, or tRump would do the right thing? I don’t see it happening.

You are right. But maybe they are forced to do the right thing or a Court decides that all these blanket oversight subpoena rejections are…obstruction of justice.

At least, since November 2016.

I’d say he wants to but the GOP Senate is too afraid to hear what he would have to say in sworn testimony.
