That is an impressive pleading. No matter how sleazy the topic, and how much you dislike both sides, it is always interesting to see good fighters fight.
Proving that she hired great lawyers, suing Ailes, not Fox and only Ailes. He’s the one who committed the crimes not Fox News.
Ailes is so full of himself, and so used to using his “news” organization to carry out his personal vendettas, that it may not have even occurred to him that he is a separate entity from Fox News.
Ailes’s lawyers could try to bring it back under the contract by arguing that sexual humiliation of talent was an integral part of his job as boss of Fox News…
I’ve just read the TOC and scanned the text, but it’s clear that the entire lawsuit was framed, pled and designed with the primary objective of avoiding the Fox arbitration clause, and now we get to see if they succeeded. Most of this brief was probably written before they filed.
I’m also increasingly beginning to suspect that Megyn has a settlement agreement over sexual harassment claims against Jabba with a strict confidentiality provision and the trash talking by unnamed Fox insiders is tickling dynamite.

She does have an important point to be made although I still have a difficult time being completely sympathetic to Gretchen Carlson. She was willing to put up with this behavior and endorse FOX’s constant anti-women, anti-poor, etc. messages while she amassed a fortune. I suppose it’s better late than never, but . . . .

Fair enough. I wonder, however, if Gretchen would have said anything if she had been given her preferred show and time slot. Sexual harassment is real - I would never dispute that and I hope she is successful in this suit. I guess I have more empathy for the single mom who puts up with it to keep feeding her kids than I do in this situation.
