Well, I guess this proves that for-profit health insurance simply doesn’t work.
Because the incentives are all wrong. Why not put every penny of health care dollars into, um…providing health care?
Hard to see how a determination that the HHS violated the law is a “victory” for any US citizen, but then we are talking about the GOP. Pay the Treasury what is owed and move on.
Edited to add: I find it amusing that the GOP is basically saying, “too much money went to private companies trying to provide insurance to poor people! More money should have gone directly to the government!”

By all means, let’s scuttle the risk adjustment, reinsurance, and risk corridor provisions of the ACA that protect the insurance companies against the transitional costs of the ACA. Instead, let the invisible hand of the market place and the unerring genius of free market capitalism sort itself out.
