Discussion: 'Full Cave': Nadler Promised Not To Subpoena Whitaker Friday

sorry kids, but this is a full cave. Not only did Nadler promise to not supoena whitaker today, he also promised to negotiate any disputes with the Justice Dept, rather than issuing a subpoena and letting the courts figure it out.

That’s a full cave whn you;ve got subpoena power in you pocket.

Does TPM read its own reports, one headline 15 mins before this one states Nadler will not use the subpoena for now but will get what he wants, this one says cave.

Yeah, you give them the chance and then you issue subpoena mid-hearing and hold him in contempt if he refuses to answer OR invoke executive privilege. That’s what Nadler should do and it is a cave if he does not.

Remember when Nixon got run out of office and Republicans spent the next 40 years trying to run a Democrat out of office? Well Trump caved and now Republicans are furiously dashing about looking for caves…

Nah, he’s promised in the hearing that he won’t even after Whitaker did not answer the question AND refused to formally invoke executive privilege. He heavily implied he’s going to do it after the hearing though. Disappointed because this will draw the stupid dance out for more days. So tiring.

It seems to me, and please excuse me if I am wrong, since, unlike Pope Donald I, I am not infallible, all of these Republican Reps and Senators named “Collins” (Susan, Doug, Chris) are rather dim bulbs, aren’t they?

Whitaker can’t invoke executive privilege. That has to be done by the WH with specific justification for the privilege. Either way, Whitaker and the WH get are in a bind; actual or perceptual. Don’t follow the R’s reactionary playbook, but be methodical and courteous as they tighten the noose around their own necks. As much as it would look/feel good to slap the mf’er with the subpoena, this is the logical way.

Hey, TPM! Nadler also stated that the committee will go after Whitaker even if he is a private citizen if he has been found to be lying, no matter how long it takes. Doesn’t sound like a “cave” to me. A “full cave” would be Nadler allowing Whitaker not to testify in the first place.

Yes! And that’s being talked about right now. By saying that, Whitaker locked himself into that answer. He opened the door and sealed his fate if that statement is eventually proven to be false.

Apparently you prefer to rely on Repub Collins’ characterization of this as a ‘cave’ rather than to listen to what Nadler said today (link above) ? (usually @caitlinmacneal is more careful with her writing ).

That’s the way I interpret it myself. WhIitker is giving testimony under oath to Nadler’s Committee, so what difference does it make how he got there?

Slang sometimes can be effective in communication. Sometimes not. In 2008-2009, the term “bailouts” was improperly (but effectively) used to garner support for the TeaParty

In this case, the use of the term “cave” is actually causing more confusion and misinformation than what Nadler is actually doing.
