McDermott isn’t exactly a fly-by-night law firm. They certainly went into this knowing the difference between permissible representation and impermissible representation.

It likely would be legal for the Trump campaign to pay Cohen’s legal bills in the Russia investigation, as long as both parties agreed to it, since that probe grew out of the 2016 campaign, experts in campaign finance say. But if the payments also cover McDermott’s representation of Cohen in the probe into his finances, they could violate campaign finance laws.

But, um, didn’t Mueller refer it to SDNY because it was not relevant to the Russia investigation?

Any money around Donald Trump will be used by Donald Trump for whatever he needs or whatever strikes his fancy, regardless of what the money was actually earmarked for. Exhibit A: Donald Trump’s “charity” foundation.

The investigation has been going on for months. It came “out of the blue” for Cohen only when the feds raided his house, office, and hotel room.

On the one hand, the same lawyer can represent a client on different matters and bill them separately. On the other hand, it introduces a heck of a complication and yeah, potential ethical issues. I hope the firm has some very specific paperwork from Cohen saying that he’s ok with the same lawyer being paid by trump’s campaign and by him for things where their interests may conflict. Because otherwise there’s little question it will be a subject for both appeal and malpractice litigation once Cohen gets clobbered.

This arrangement stinks to high heaven. it raises some serious campaign finance questions (use of money donated for political purposes for defense of a third party’s common garden variety crimes) and legal ethics. Just who do those lawyers represent and what happens when Cohen’s interest split from Trump’s which will happen soon if it hasn’t already occurred.

I wondered about that myself.
According to last night’s Maddow, a good part of the Cohen raid was explicitly focused on Drumpf. The charges were redacted in the public presentation, but are generally known to relate to campaign finance, bank and wire fraud. I’m thinking Cohen was involved with illegal contributions and a slush fund (which brings in the silencing payments to various former lovers.) While I think it’s worth asking whether or not Donnie represented these contributions as his own money, I’d guess these weren’t dominantly Russian or apparently Russian-influenced, or there would have been no need to refer the case to SDNY as they’d have fallen within Mueller’s purview.
