Discussion: Federal Judge Blocks Obama's National Directive On Trans Students

I don’t see why Title IX would need to mention gender dysphoria. It’s really quite a simple concept: trans individuals are being treated unfairly on account of biological sex. Similar to the concept that others have argued regarding gay folks: their ability to marry who they wanted was thwarted just because of the biological sex category to which they belonged. That’s why so many see Title IX as including protections for trans people–it’s no stretch to interpret the existing verbiage as including people who are treated differently according to their biological sex. Further, I’m sure you very well know that it would probably be impossible to pass a standalone law through Congress. Most Republicans cling to the convenient but dismissive cliche that “no one should be discriminated against,” but refuse to allow their preferred sort of discrimination to be explicitly forbidden. Meanwhile, trans people continue to face backlash and ridiculously inhuman treatment from institutions and society at large, but most Republicans consider that a feature rather than a bug.
