Awwwww, the Second Circuit thinks we still have a functioning Congress that’s capable of enacting legislation on urgent matters of public policy. That’s cute.

That’s not quite how I read it. The key word is “pause.” I read it as, “we’re going to give you one more chance.”

Worth nothing that the 2nd is likely the most sympathetic toward the national security apparatus of all the circuits.

That’s what I mean. They’re giving them a chance. The Second Circuit is like New York City–very liberal on some things, but Big Finance and terrorism are exceptions.

Didn’t Obama already change this a long time ago so the database is in the hands of the phone companies? This is a stunt, and judges should know better.

Not that I think it’s an improvement that the database is in private hands, now AT&T and Verizon can sell that information to anybody for any purpose; before it was tightly held for national security purposes only. I wonder what interesting robocalls and bulk mail you will get if you call a rape counseling or suicide hotline.

You are missing the real story here, which is that Edward Snowden is an egomaniac. Only revelations made by people of impeccable personalities count. Find a quiet, humble person who, at the same time, is willing to risk life and liberty to expose vast overreaches of power, and then we can talk about the NSA.
