CIA Director is a Senate confirmation position, as is SecState. Mike Pompeo moved to SecState from CIA pending Senate confirmation. I may be mistaken, but Congress wasn’t empowered to prevent Pompeo’s assumption of SecState responsibilities pending Senate confirmation. Trump just put him there. No recess appointment malarkey required. I suppose he could similarly plug Pruitt into AG, with Pruitt having sufficient time to perform a lot of Trump’s dirty work before confirmation hearings were convened. And just like Pompeo’s interim decisions will likely stand even if not confirmed as SecState, so would be Pruitt’s as acting AG, no?

Its a bit of a gray area. Its also one that Trump has been pushing the envelope on pretty much since the beginning…appointing “acting” heads that require confirmation, and then dragging his feet on actually submitting their names as nominees.
Yes, the President has the authority to appoint “Acting” heads, and yes, they still require Senate confirmation for their new role. But there are situations, like the new head of the VA appointment, which don’t fall into that box, because Trump fired the previous VA head. In that case, the chain of command takes over, and Trump doesn’t get to appoint an “Acting head”…but he did anyway. Which will bring into legal question each and every decision the new “Acting Head” makes.
Moving Pruitt to DoJ will create even more chaos. Because its extremely unlikely that Pruitt will receive confirmation for AG (or anything else at this point). So consider a scenario…Trump gets Sessions to resign (because firing him gets him tangled up like it did at VA), appoints Pruitt as an “Acting AG”, Pruitt takes action, Pruitt doesn’t receive confirmation…were the actions he took legal and binding? Maybe…but there would be plenty of fertile ground to challenge each and every act in court.
And take that scenario down one level closer to the ground…let’s say that Pruitt fires Mueller as one of those actions. That guarantees he won’t receive confirmation, btw, but what it also does is royally piss off every republican in the Senate. And the mood for impeaching Trump moves decidedly into the “HELL YES” category.
And its not that Trump wouldn’t try something so harebrained…its just a great hypothetical situation to show how Trump can make any bad situation considerably worse.

Yes, it is monumentally stupid the take the fall as legal consequences could cause him the loss of his job, fines, legal fees and jail time!
They’re not even trying to make their lies seem plausible any more. The effort of trying to do that is killing them, with so many, many lies.

Certainly there’s another job out there for such a talented, and loyal, individual! With Treasurer for the Trump 2020 likely off the table – last night’s footage just may not play that well during the reelection – I’m supposing we can look forward to Ryan Jackson taking a position with Cato, Heritage or some other source of wingnut welfare. They’re really too young to be spending so much time with their family.

But I don’t think he’s being fired. To paraphrase Huckster Sanders: Ryan Jackson is just too valuable as Pruitt’s righthand man in the massive effort to return the EPA to its original purpose.
