There are no more recess appointments because the Senate no longer recesses. Someone hangs around and gavels it into session every three days and then shuts it down again. So long as there is at least one Senator from the opposition party, there will never be another recess appointment. As far as I know, this was sparked by Dubya’s recess appointment of John Bolton as Ambassador to the UN.
Obama tried to challenge the practice when he made a series of recess appointments despite the Senate meeting in pro forma sessions every three days. But the Supreme Court ruled against him saying the Senate was not technically on recess unless it was away for at least 10 days.

Environmental Protection Agency Chief of Staff Ryan Jackson is taking the fall for the controversial, hefty raises given to two of Scott Pruitt’s closest aides who joined the EPA after working with Administrator Pruitt in Oklahoma.
But of course!
Trump is saving Pruitt for a higher purpose. By keeping him on in the face of multiple ethical lapses Trump has created a huge “owe me”. Trump needs Sessions gone in the worst way, yet replacing him sets up a confirmation fight fraught with peril post-Sessions firing. That’s a fight Trump doesn’t need, for much could go sideways on him. So, plug in Pruitt. having already been confirmed for the EPA he doesn’t have to endure the process again. And he’s such a craven toady he’ll do exactly as told by Trump once he’s AG.
Trump is terrible at containing anger, and absolutely doesn’t endure losing. He’s not going to sit idly by after this Cohen raid. Absolutely won’t. And he’s done heeding the counsel of cooler heads. Look for Pruitt as AG soon. Failing that scenario playing out Trump is still lopping heads, starting at the top and moving down multiple rungs on the ladder. He will not be crossed.

Everybody loves repeating this, but I’m reasonably confident it’s not true. You are confirmed as US Attorney General, or Secretary of the EPA, or whatever. You are not confirmed as “Whatever Secretarial Role the President Wants You to Fill Today”.
Chief of staff was damn slow crawling under the bus. Pruitt needs to put more thought into his new hires.
Pruitt told his staff repeatedly not to grant any raises without his direct authorization, but that damn soundproofing…
Anyone who has any experience with organizations, whether private or governmental, knows that this would NEVER EVER happen. Chiefs of staff do NOT make decisions like this without the knowledge of the boss. Never ever. Period.

There doesn’t seem to be any case law that pertains to this, but I’m sure you’re right. For one thing, the Senate wouldn’t stand for it. Confirmation hearings are geared to the candidate’s qualifications for the specific office he or she is to hold. The notion that Ben Carson or Betsy DeVos could be made Attorney General without Senate confirmation is ludicrous. Perhaps tena can give us the definitive word on this.

You may be correct. However, an acting AG could be appointed, and I’m assuming that’s at the prerogative of the President. And pending confirmation that acting AG could take steps Trump intimated he deemed necessary to assure his survival in office. Would those actions be reversed if that acting AG wasn’t confirmed? Terminated persons restored to offices they were relieved of? Halted investigations restarted? Trump’s disdain for the laws and procedures, along with an obsequious Congress unlikely to call him to task, might permit him to bluff and bulldoze his way through a lot of troubles. The courts? Who knows? Would I depend on a 5-4 slapdown of Trump from SCOTUS when the Republic was on the line? Nah.
I think his only misery is the public exposure. Internally he’s basking in the glory of his accomplishments.
So many rivers to pollute, so much air to poison, so little time. Neither raises nor condo nor air travel nor sound proof booth stays this true patriot from the swift completion of his appointed rounds.

So why isn’t there something about the chief of staff being fired? I mean if he really did do this with out Pruitt knowing he would be fired on the spot right?
Hartd to see any other way Trump could ram AG Pruitt through Congress… so, the fact is Pruitt will likely NEVER be the AG?
Or is there an alternative we are missing here?
Should we just stop speculating it could even happen?
