He doesn’t need to be either. Just remember the administration’s rule, you either get on board with the program or you leave. So I don’t think he has a choice if he wants to keep his job.

Under President Trump, the Department of Justice has become corrupt and an instrument of government tyranny as it was under President George Bush the Dumb Torturer who used the Department of Justice to justify torture.
I think maybe Drumphf’s doctor ghost wrote this, the bit about it being the most legal executive order with zero depth, it sure sounds like his work.

Bingo! It sounds like the best they could come up with - after the fact - to cover their asses was, “Well, yes, that is the President’s signature, apparently witnesses were present, and golly-gee it’s even on the correct line … unlike last time.”

So what? It was just legal butt-covering for an unnecessary, Potemkin-village ban to sate his clueless base. The EO does nothing more than say, “Maybe there’s more we can do, so let’s ask around. In the meantime, let’s stop Muslims from coming in. And no more than 50,000 Syrian refugees. Enough with the Syrian refugees. Losers. Sad. I like Syrians who don’t fugee in the first place.”
Journalists need to use plain language. They should state an interpretation, such as, the OLC review looked at the formatting and style not the actual legal issues such as constitutionality

Oh, and personally, I suspect this may have been hastily produced after the 27th to counter the many reports of the administration’s failure to run the EO by appropriate legal counsel. Those reports kept coming for nearly a week before they released this thing. I certainly may be wrong, and in any event we’re unlikely to find a smoking gun on that score, though your assessment just confirms my belief.
