Discussion: DOJ: Civil Rights Act Doesn't Cover Discrimination Against Gay Employees

You might say the same about women’s rights to access birth control and abortion, which I thought we had settled in the 70s.

Once again, ol’ Jeff Sessions, the closet KKK supporter, is fighting a war most of America thought was long-ago decided:
“the Seventh Circuit [fed. Court of Appeals in Chicago] held today [04-04-2017] that SEXUAL ORIENTATION DISCRIMINATION IS A FORM OF SEX DISCRIMINATION forbidden by… the Civil Rights Act of 1964. The vote was 8-3. The opinion in Hively v. Ivy Tech Community College, by Judge Diane Wood, reasoned that sexual orientation discrimination is essentially indistinguishable from sex discrimination because the former relies on stereotyped concepts about how men and women should behave sexually and about with whom they should associate in their intimate lives.”

“Argument not going anywhere?”
If he throws in “because cooties” would that help?
Seriously, at lunch I was on a supermarket checkout line and before I could cover up the Enquirer displayed there I noticed that that the corner had fallen open to a headline inside “Sex virus” in big type.
That graphic layout person probably pulls down more than America’s 100 greatest public-school teachers combined.
I put a copy of People on top of it.
For the children.

How do you handle the “but for…” problem?

But for Trump…Pence.
But for Sessions…unknown obsequious toady who will be worse.

Seriously, I’m conflicted on how I think this clusterfuck should be managed. It’s like, OK, shit’s on fire yo, but the flames are the only thing keeping worse horrors from escaping.

Is a racist, bigoted, backwards shitbag who is in conflict with Donny Two-Scoops worse than the racist, bigoted shitbag yes-man DTS will appoint?

I struggle with this. The thing that makes me lean towards “DO IT YOU COWARDLY MANBABY!” is that firing Sessions might just be enough for a few GOP senators to find a spine and stand up to DTS.

If the Senate does not go into full recess - I guess by doing that little pro-forma thing each day? - that will be a clue as to whether they’re serious in their defense of Sessions.

I was sorry to see all the bookstores close because I used to spend time in Borders turning Ann Coulter’s books over, hiding Bill O’Reilly’s latest and generally making work for the staff but it felt good to me.

Thank you. That was your random act of kindness for today.

Throw in the discharge of aggression, and it was a winner.
@tena Just as well, in some places they’re looking at laws to police such heresy.

Other than Spicer, for all the lawyering up, everyone is still in place, no?

Well, someone like that has no chance of being confirmed. If Congress recesses, and that is not at all certain, and he makes a recess appointment and that appointment fires Mueller, then we have quite a circus on our hands and something will finally have to give and we’ll know where we are.

We’ll also know who we are and what we stand for.

Woa there!

The Equal Protection Clause of the Constitution protects them, not the Civil Rights Act.

The SCOTUS made this clear in the Same-Sex Marriage ruling that all LAWS must be applied equally, so prior rulings DO apply already.

The Circuit Court judges can use that ruling as a “Get out of my Courtroom Free” card.

Yep - that’s another reason this argument is spurious.

They can’t use the Equal Protection Clause -it would violate it. So they are trying to use the Civil Rights Act instead and it’s not relevant.

As to how to manage it, it’s asymmetric: once the Carnage is triggered it can’t be undone. Doing nothing can be reversed anytime.

WHY??? WHY do they have to be such AHOLES? This is a totally dick move (no pun intended). We move ahead. We proclaim that no one is ‘a little more equal’ than others under the law and these bigoted pieces of dung roll it back BECAUSE THEY CAN??? I will never make it through the next 3.5 years.

He’s in it for the Chix–The chik-fil-a’s. He’s got a lifetime gift certificate.

It’s just mean - absolutely.

Colbert went off on that last night.

Then FIX IT by getting out there and working your ass off to elect every single Democrat (or Independent) you can to the Senate, the House of Representatives, and your State and Local Governments.

The US Congress is the ONLY body that has the Constitutional Power to tell Trump to go fuck himself so we have to make sure 2018 is not only a WAVE ELECTION, but a TSUNAMI ELECTION that sweeps Republicans from power in BOTH houses of Congress.

ONLY THEN will we have the ability to actually reign in the Malignant Narcissist in Chief and begin to repair the damage already done.
