Discussion: Dems Finally Have A Chance For Revenge On SCOTUS, But Will They Take It?

Based on recent history and the current methods of the Republican Party, I’d personally be shocked if they don’t immediately go nuclear to ensure they get their guy on the court as soon as possible.

Yes, that could backfire on them in the future. But I don’t think Republicans intend to be the minority party again in the future, so I’m not sure how much “down the line” consequences are entering their calculus anymore.

Our new motto should be “Eight is enough.”

I am actually torn. Just because Republicans did something doesn’t mean that we, as Democrats (who are inherently more go-along-to-get-along than the GOP), should do that same. That’s like saying that we should torture prisoners because ISIS tortures prisoners. I no more want the Republican Party as my point of reference than I want ISIS.

That said, the manner in which this seat remained open for Trump is reprehensible. It was, literally and figuratively, stolen from President Obama. That MUST have consequences.

I believe the correct position is this: announce that this particular seat will remain open. No hearings, no compromise. State clearly that Democrats are doing so because of the manner in which Mitch McConnell conducted himself after Scalia’s death. Than, at the same time, announce that any FUTURE openings will be businss as usual. Hearings, a committee vote, etc. Don’t let McConnell off the hook, but don’t gum up the Senate forever.

McConnell will then have to decide, in light of an upcoming midterm election with what is likely to be an enormously unpopular president, if he wants to go nuclear. He knows better than anyone that if Trump is toxic and he loses seats, Democrats can stop everything with just 51 votes, should he eliminate the filibuster. He wrote an autobiography called “The Long Game.” I believe that’s what he plays. I’m not convinced he’ll eliminate the filibuster.

Probably not. They’re Democrats, the “when they go low, we go high” cowards, capitulators, and enablers.

This is another chance for them to “go high” while we get screwed.

This is why Democrats lose elections: they allow themselves to be rolled by Republicans.

The operative question should be: What would the Republicans do if the roles were reversed?

The answer is obvious.

The Democrats will never win if they play by a different set of rules than the Republicans.

If the Republicans nuke the filibuster, it is gone for good. It will not come back when the Democrats regain power, as they will eventually. And good riddance. Requiring super majorities to get anything done ultimately benefits conservatives who are more interested in blocking change than promoting it.

Without the filibuster, we would have had single payer health care, or at least I so believe. Without the filibuster, the Democrats would have had no place to hide; with it, they could hide behind Republican obstructionism.

Similarly, as the filibuster dies piece by piece, the Democrats will find it easier to implement effective changes the day they regain power. They can start by raising the number of justices from 9 to 15.

Stolen? Obama could have recess appointed Garland, a pretty center right pick to begin with. Like the ACA another three dimensional chess play on Obama’s part. Guess what 3-D chess is worthless when the Republican Party takes a huge dump on the chessboard. The Dems need to use every tool in their power and then make a few up to resist these fascists at every turn. I’m talking cut power to the Senate floor if you have to. Nail all the doors shut. Difi has already rolled over and is showing her belly as usual, so I expect some hand wringing and maybe a sternly worded letter or two, but this Scalia clone will not be blocked by the Dems.

When it comes to the senatorial seats and election of the POTUS, I use as my benchmark, who gets to put the justices on the SCOTUS that I feel will best serve this country. All other issues get trumped by this one. For all those folks who went third party, sat home, or Republicans who ‘went back home’, you reap what you sow.

When this country needs measured decision making coming from knowledgeable jurists and gets party indoctrinated hacks, please don’t go whining about how horrible things are. Actions have consequences.

If you dont use the fili to oppose Gorsuch outnof fearbof the nuclear option, exactly what are you saving the filibuster for, a nominee from trump uni school of law? Especially after what they did to Garland, som tit for tat absolutely is in order.
