That’s just the point. As far as applicable, they will apply the rule. Sen. Schumer will have the votes for the filibuster without The Senators who have so far declared against it.

these two will be primaried…and hopefully lose their seats… voting republican when we need them to vote democrat makes them republican…just remember these votes are never made on principle…you just saw 2 republicon women senators vote with the dems forcing pence to cast deciding vote.

but the point is those votes are calculated in advance and if it would have made the difference they would never vote with the dems.

they knew they could vote that way for appearance not on principle.

TPM - if the article is about 2 people and their names matter, please try listing their names earlier than the 5th paragraph. It comes off as less than focused writing or like some of the click bait articles on Facebook.

Read the article. He comes off as a moderate conservative who would be primaried out by the Republicans so he set up shop with the Democratic Party.

The DNC would do well to decide what points they really, really care about and then hold the line. I would think fighting a hard right Supreme Court nominee is at the tippy top of priorities.

This argument needs to fucking die in a fire. If Republicans arevwilling to kill the filibuster to get Gorsuch into this unprecedentedly stolen seat then they aren’t going to suddeningly get the vapors over killing it when it comes to replacing one of the liberal justices.

This is exactly how Trump and the white nationalists are able to con the Democratic base to vote for Trump - Democrats with no spine and failing to fight for the regular citizens by stopping a judge for the rich and monopoly corporations!

I agree and thought the same thing. But in defense of TPM, it appears that this is an AP story that they picked up. So it’s the AP that’s guilty of bad writing.

Interesting. I was just watching MSNBC Jeremy Peters from NYT just made this exact point. That there’s no point to filibuster Gorsch since he’s not that bad of an option and just replacing one Conservative with another. However, filibustering now, will screw them the next time DJT goes to replace a judge.

I’d like to think the next judge DJT gets to replace will be a peremptory challenge. Made by his defense lawyer.

I’m dead set against Gorsuch for one overwhelming reason: The man who nominated him is not legally the president. He got there through Russia and Putin and is a goddamn traitor and should not be allowed to make any lifetime appointments, godfuckingdamnit.

That’s just stupid. They’re doing it now and they will never compromise. If the GOP says that they’re going to eliminate the filibuster if you filibuster then the filibuster exists in name only and is functionally gone already.

I hope they don’t actually think we’re that dumb and can’t see what is so obvious.

Yup. And fwiw, McCaskill came out last night against Gorsuch (her terrific phrase for what his decisions reveal, iirc, is “stunning inhumanity”) and will join the filibuster. And the number of Dems in that camp as of last night was 39; two more to go… This seems to be a day-old AP story that a weekend TPM staffer just pulled off the wire and slapped today’s date on.

Except it won’t because if they save the filibuster for next time Republicans will just nuke it then. It all comes down to how too damn many “experts” and “serious folk” ignore that Republicans have repeatedly demonstrated they wont be constrained by norms, ideals of comity, or acting in good faith and go on acting like everything is the same as it was before the Gingritch Revolution when Republicans decided they wouldn’t let little things like decency get in the way of the pursuit of power for the party.
