Discussion: Cuomo Hits Back At Trump's Whining About NY AG Probe Into NRA

Hasn’t Trump sicced the Justice Department on Hillary Clinton for sending all our enriched uranium to Moscow and all her other crimes? I for one would like them to get to the truth about Comet Ping Pong and that guy she strangled and then dragged his body into some DC park.

I will rejoice when I see it happen in real time not just in fundraising emails in my inbox.

If it comes out of Trump’s mouth/Twitter account/spokesperson, it is, by definition, “garbage.”

The President’s accusation that it is a politically motivated thing is all garbage,” Cuomo said. “We don’t do that in New York state. I think it is telling that the President would think right away, you’re using the justice — criminal justice apparatus for politics. That’s his thinking. That’s his mindset. It is not how we operate in the state of New York.”

That’s a good move: state outright that Trump is the person who misuses the legal apparatus for political purposes, and that his accusations are simply projection. Because it’s true.

I’m so glad the NY AG has decided to look into the NRA, the gun nuts and their lobbyists. And Cuomo is right to put all this in context. The only thing I wonder is why CNN doesn’t have a Cuomo interviewing the other Cuomo. Its not beneath them y’know.

Because it’s a 501©(4), it isn’t a “charity.” Instead, it’s a “social welfare” organization. Because seeking legislation is deemed to be a “social welfare” purpose, it can lobby all it wants. However, there are limits on the extent to which it is allowed to participate in political campaigns.

I think there are two separate issues regarding the NRA that should be the subject of investigation. The first is whether NRA leadership has been involved in financial improprieties. The second relates to whether the NRA violates limits imposed by 501©(4) on use of funds in connection with political campaigns.

Financial improprieties can be investigated by the feds or the NY AG, and it appears the latter is fulfilling her responsibilities by conducting an investigation. Violating the restrictions imposed by 501©(4) can only be investigated by the IRS, and unfortunately there is no indication that the IRS is carrying out any such investigation.
