Sure looks like a spoiled ballot to me–for the delegate race. (I don’t know if Virginia law would require the entire ballot to be thrown out.)
Ballots will be recounted Thursday in the Fredericksburg area’s 28th District. The Republican candidate there leads by 82 votes. But Democrats already have asked a judge to call for a new election after at least 147 ballots were found to be assigned to the wrong districts.
There’d better be a new fucking election. And I would love to see some Virginians on the streets about this, although that seems a bit incongruous. Because I’ll bet that the judges were swayed, as they always are, by the prospect of Republican wrath. We have to make our own noise now. We can’t have a situation where we’re fucked by gerrymanders, voter suppression, election rigging AND judicial sabotage.

This is totally false. The voter voted for Howard Gwynn, Gabe Morgan and Marty Eubank, all of whom are Democrats. S/he voted for Donald Woodruff as well who is an independent.

Correct. If we are to start attempting to interpret a spoiled ballot, we have to go by the voter’s own rules. And if a filled-in bubble with a slash counts as a vote for the Republican for governor, then the same mark must count for the Democrat for the House. But they got a three judge panel to rule that this was a vote for Yancey??
