They are challenging the courts interpretation of āofficial actsā and how that was applied in his trial, I believe. The Appeals court thinks there is a legitimate question of law in that regard. Itās not terribly uncommon in white collar crime to remain free pending appeal. Horribly unfair in some cases, but not terribly uncommon.
EDIT: Question of law does not mean that they think McDonnellās interpretation is correct, just that it likely should be reviewed.

Heāll never serve a day in jail, write a book and reap millions, marry a trophy wife after unloading the (alleged) harridan and generally come out of this smelling like a rose. Crime pays, donāt let anyone tell you otherwise. You just have to commit your crime on the big stage, for big bucks.
