Hence the term ā€œpolice state.ā€

Iā€™m sure the cop felt threatened as if by a demon and a thorough internal investigation will prove that.

The same police inspector, Brian Stansbury, is one of the officers currently being sued by a black San Francisco police officer. That police officer claims he was racially profiled during a traffic stop and then allegedly choked and tackled to the ground by officers in May 2013.

Unless the Judge that reviews this, and one will, is an absolute Cop sycophant, this isnā€™t going to go well. Itā€™s a false arrest in the conduct of obstruction of justice. Any Judge that allows this to stand is putting a serious screwing on justice in America.

The old argument used to beā€¦" which came firstā€¦the chicken or the egg". Now its " what came firstā€¦the arrest or resisting arrest".

ā€œIf you continue with this I will arrest you for resisting arrest.ā€

Chicken and egg question.

I dunno.
Maybe cops should do one year on duty-- one year off.
Periods of decompression should be mandated for LEOs.

For those of you following along at home. Citizens taking pictures of police shooting teenagers - bad. Police arresting attorneys standing in front of their clients while trying to prevent pictures - good.

If the police do it, itā€™s perfectly legal. Why would they do stuff thatā€™s illegal?

How in the world can you be arrested for resisting arrest? Donā€™t you need to be being arrested for an actual charge first and then start resisting THAT arrest? Itā€™s a BS charge.

Iā€™m sure that while they were arresting her on no charge, they quickly and thoroughly took the photos which they were not entitled to do.

Wonder if that angle is being discussed, and what the remedy will be?

OK, this one is all on film, I guess all anyways. Lets see what difference it makes.
Clearly the cop is in the wrong and in several ways Iā€™ll say, seeing that she was in the act of representing a client at the time, was not resisting and the cop was taking pictures that he probably shouldnā€™t have been.
The cop is ballsy, if nothing else. I mean, he arrests a lawyer for basically no reason while completely having it all filmed. Thatā€™s supercop ego and then some.

I freely admit that I am not an attorney; a simple person, although with some higher education credentials. I like to think passably intelligent with some defensible measure of common sense.

With that said, can a knowledgeable person on here explain to me how this is legal? It seems to fly in the face of a common personā€™s understanding of the attorney-client relationship; and the protections of the fourth and sixth amendments.

Most cops are ā€˜ballsyā€™. Thatā€™s the problem.

This cop is my nominee for ā€œThug of the Weekā€ contest. And his supervisor should be suspended till further notice.

Only when the police thugs supervisorā€™s get punished will the problem of police misconduct and violence be recognized.
