Discussion: Cohen Team: DOJ Can't Review Seized Docs Because of 'Impartiality' Concerns

I think that’s about the size of it.

They all know full well that whatever transpires here can form the basis for a future appeal. That’s one reason attorneys make such motions and respond the way they do. I’m not an attorney, but I do know that objections to certain things must be voiced in court, for example, in order to have a basis for a subsequent appeal. It’s part strategy, part posturing, but it’s also what attorneys do. File it all, bill 'em, and see what happens.

Also, don’t forget the fact that these attorneys are billing probably around $500 per hour. That’s a lot of money for each lob. The other side lobs back, and, presto, more billable hours responding. Back and forth. As I’ve noted here before, there is absolutely no downside for an attorney filing something totally inappropriate, so don’t be surprised by any sort of nonsense.

Here, the judge will say, I’m pretty sure, that justice trumps whatever these clowns are saying, and they can have their day in court later where they can try to show bias, or whatever.

It’s sad that this kind of sexism still exists, but it does in many fields. We 5’ tall females just have to be prepared with our materials, firm, and unwilling to accept any nonsense right from the beginning. (My model was 4’10" Sister Camille - my Latin teacher who could make a burly HS football player cry.)

Donald’s staff can’t be trusted, so trust his staff to be honest.

Man, Bill Clinton wasn’t half as slick as these shysters. Of course, they’ve got a lot more experience at it.

Trump has attacked the federal judiciary on a number of occasions -Judge Curiel, Judge Robarts, and the entire ninth circuit. It seems to be a pattern.

Can somebody explain to me why Cohen paid Stormy with money from a “line of credit”. The guy has millions? He doesn’t have $133k in a chequing account. Very weird.

At what point does Cohen start gnawing his paw off?

Shorter Hendon: One of my client’s client’s is now the President. That’s so special that none of the usual rules apply.

This statement in the letter suggests that Judge Wood is not going to buy Cohen’s argument:

“Friday’s hearings were marked by a focus on whether Mr. Cohen could ethically divulge the names of his non-publicly known clients. We still believe that Mr. Cohen is not allowed by the ethical canons to divulge the names of clients in this case where the identities of the clients are not publicly known. We recognize that the Court has stated that it is ‘likely to discount the argument’ that the Government has seized thousands of privileged documents unless Mr. Cohen produces a list containing the identities of his clients at this time. See 4/13/18 Tr. at 65. However, we respectfully request that the Court rule on Mr. Cohen’s application based on the information provided above, which is as much as we feel that Mr. Cohen can legally and ethically share.”

From all reports of Friday’s hearing, it was dominated not by the protestation of Cohen’s “ethical” obligations but whether his lawyers were able to produce the names of his clients. The judge was reported to be quite frustrated with Cohen’s lawyers and ordered hm to show up today. The letter brief concedes that the names of clients aren’t privileged. There is no way that privileged materials can be identified without the names of Cohen’s clients and the communications as to which he asserts privilege. This is just so bad.

I do hope we get video of that event.

Nah, it’s Vlad but he wants his name hidden because he just finds it all so unseemly that he doesn’t want to be associated with it. I mean really, poisoning your opponents is one thing, sure - but this stuff is just tacky!

Obviously there is only one man capable of reviewing these files with any level of impartiality…Devin Nunes!

Right?! This is like white privilege on steroids. Can you imagine if LaTron Jackson’s attorney tried to argue in court that the police evidence should be thrown out because cops don’t like accused drug dealers?

Any of them apply to this situation?

Or that the President has suggested executing them?

It looks like they are going with the “deep state” ploy there. They will recognize no actual authority beyond that of their own.

No idea why this popped into my head, but I see them all participating in the “Master of your Domain” Seinfeld episode.
