Discussion: Cobb: McGahn Recused His Whole Office From Mueller Probe

Still, isn’t it clear: There’s no need for recusal if nothing bad was done.

It’s not a witch hunt, nothingburger, if there are multiple indictments and five guilty pleas. And apparently more to follow.

Why is anyone lawyering up, if there is no wrong-doing?

Well, sometimes you recuse yourself to avoid even the appearance, or the potential, of compromise.

What McGahn did (recusing his office, at which point Cobb was hired) was sensible.

Good! All who were recused should be deposed under oath. Obviously, they likely have knowledge of Russian interference.

I remember when the standard was to avoid the appearance of a conflict of interest. Instead of “If you can’t prove that the money changing hands was specifically for an unlawful purpose, then it’s OK.”

It never, ever does to forget that Don McGahn is one of Charles Koch’s men in the White House. Never.

This whole scandal continues to unroll without check because–well, because of checks, large ones, written with a lot of zeroes on them, payable to Republican attorneys, journalists, operatives and politicians by the Koch apparatus.

As long as Charles Koch believes that the disruption, lawlessness, and even outright treason being churned out by the Republican Party will benefit his long-term project—to transform the US into a kind of tax-free, regulation-free, billionaires’ paradise— then this strange status quo will persist, in which the law is trampled and the constitution violated on a daily basis, in which the constitutional crisis grows and metastasizes, while Republicans dedicate themselves to seeing no evil, hearing no evil, speaking no evil, and recusing themselves from any obligation even simply to bear witness against evil.

Yes, of course there is. For example: you’re a judge and the defendant was in your class at university. Or: you’re a judge in a fraud case and your wife was one of the victims. Or: you’re a judge and your wife is the prosecuting counsel.
