Kathy Hochul, the Lt. Gov, lost the district very narrowly to Collins in 2012. Cuomo could replace her fairly easily if she wants to give it another try,

He goes back to Congress. Being under indictment (and his case surely won’t have been resolved by then) isn’t a bar to taking a seat in Congress. Even a convicted felon can be sworn in. It’s up to the House to expel someone. If Collins is in prison, even a Democrat-controlled House might not expel him - after all, he can’t vote from the pokey.

My guess is that by not actively campaigning he can use those campaign funds to pay his legal fees, yet still remain on the ballot. What a jerk.
